Those problematic fibers

Interesting story in the Cape Cod Times on Saturday under the headline, "Post-trial: DNA tests, appeal in works."

"Cape and Islands District Attorney Michael O'Keefe said yesterday he would test some of the DNA samples in the state police crime lab that were not previously tested, but not because he expected to gain any new information," wrote Times staff writer Hilary Russ.

"'I have asked that certain testing be done only because it became such a huge issue at the trial," O'Keefe is quoted as saying. "I want to see that those who have questions, even though we may not feel that they are persuasive at all, attain some level of satisfaction."

Russ goes on to write that "one piece of evidence in particular -- the external vaginal swab collected from Worthington's body -- came up in trial when an expert for the defense, Richard Saferstein, pointed out that though it tested positive for semen, it had never been DNA tested for a match to McCowen or anyone else."

O'Keefe (shown in the photo above) described this as "a red herring" and said the protocol at the crime lab "is to test only internal vaginal samples, which can prove penetration and hence rape charges," Russ writes. On this point, O'Keefe said, "the laboratory's experience is that what comes out is a seepage or a drainage."

But whether DNA from the external swap matches with convicted killer Christopher McCowen was one of several areas of uncertainty raised by Saferstein, who spent 20 years working for the New Jersey state police crime lab and wrote a widely-used text on forensic science now in its ninth edition (the sperm found in Worthington's vagina did match with McCowen's DNA, to a 1-in-199.8 billion chance it wasn't his).

Saferstein also pointed out that white and blue fibers found on Worthington's genital area were not tested by the crime lab -- and as those who followed the trial are aware, Jeremy Frazier, the Wellfleet man alleged by McCowen to have killed Worthington, was wearing a white and blue sweater on the night the prosecution believes Worthington was murdered.

"But O'Keefe said he had no intention of testing those fibers," Russ writes. "I don't find those persuasive," O'Keefe said. "Fibers are very generic. Many people have sweaters with blue and green or whatever the colors were. You can conjure up any kind of expert these days to say anything."

But Frazier was not the only person wearing white on the night of the murder. So was McCowen, who can be seen clad in white pants on video footage taken at the Juice Bar. And that fibers from Frazier's sweater could have transferred to McCowen's clothing, and then to Worthington, is hardly beyond the realm of possibility.

O'Keefe deserves credit for taking a risk in ordering further tests of the evidence, and I won't be surprised if the external swab matches with McCowen's DNA, thereby demolishing one of the doubts in this case. But I wish O'Keefe had gone a step further and asked for the fibers also to be examined for a possible match with Frazier's sweater. Yet O'Keefe is not alone in declining to make this request.

Another person with a prominent role in the trial -- arguably the most prominent -- could have asked for the fibers to be scrutinized for a match, and chose not to: Robert George, McCowen's attorney.

Nor did George seek for any other forensic evidence to be further examined during the trial. Nor, for that matter, was such a request made by prosecutor Robert Welsh III.

That O'Keefe wasted little time in requesting more DNA testing -- only one day after the verdicts against McCowen were announced -- shows that the issue hovered like a pall over the prosecution's case, and O'Keefe is moving quickly to resolve it before the case is heard on mandatory appeal or possibly overturned.

But it was George with much more at stake in leaving the issue unresolved -- the potential for his 34-year-old client to spend the rest of his life in prison. Perhaps an arcane rule of law would have prevented state police analysis of evidence during the actual trial, but even so, nothing would have prevented George from filing a motion to that effect. Even if his motion was rejected by Judge Gary Nickerson, George would have been on record as wanting the issue resolved, and let the chips fall where they may. And whoever filed the motion would have put the other side in an inherently defensive position when it came to the forensic evidence.

That George chose not to take this path means, at least as I interpret it, that he could not be certain of the results. Faced with this uncertainty, George apparently decided it was preferable to leave doubts in the minds of jurors about the work of the crime lab, rather than seek further analysis that may have only further incriminated McCowen.

Well I would think that when a murder occured, you'd want to check all the DNA.

Also, this is coming from the same guy that wanted to check the DNA of everyone in town?

I know for a fact that O'Keefe is incorrect. Yes, semen/DNA obtained from the vagina helps the prosecution meet the legal definition of rape. The state lab runs any & all tests on biological material per request of the prosecutor's office. To wit: the prosecution did not request this test and O'Keefe is a hypocrite & working over-time in cover-up mode.

After watching Greta's program on the JFK cover up why doesn't O'Keefe test all DNA for everyone interested in closure including McCowen.

Are we going to over tax the lab our taxes are paying for? Will it interfere with their coffee breaks? Is he covering for someone else? Sounds like the same old corrupt Massachusetts.

Jack, Good point about George. On the other hand, most jurors do not understand that the defense has the ability to request extensive DNA testing, multiple forensic examinations and opinions. Its the prosecution's burden, however in MA the prosecution often fails at this - and then resort to desperate and underhanded tactics. I work in the area of post-conviction relief and see this mistake, time and time again.

If it crossed my mind that George could make this request, SuzieQ, I'm not sure why it wouldn't have crossed the minds of jurors (and I suspect it probably did). George opened the door to this aspect of the case, but appeared unwilling to see what was beyond the doorway. The outcome of the trial speaks for itself as to whether this was a sound strategy.

None of us can say for certain whether it crossed their minds, KMA. And as I pointed out in the post, an arcane legality may have prevented analysis during the trial. But this would not have prevented George from making the request. And if hypothetically the motion was rejected, George wins on two counts -- he appears confident that further scrutiny of evidence will exonerate his client, and the court appears heavy-handed in thwarting this attempt.

How long will it take you to test the seminal fluid....12 months like the last time?

So what if the seminal fluid does belong to McGowen, it's irrelevant & wasting tax payers dollars.

Instead, lets have all the Truro cops including Mr. D.A. man, provide THEIR DNA sample & do some testing on the DNA evidence of 3 other males under Christa's fingernails....why wasn't that tested? And yes, the blue & white fibers.....LEAVE NO STONE UNTURNED....

All I can say is be patient, sit back & wait for "revenge is a dish best served cold".....

I know Bob George is in the stages of investigating what happened behind the scenes at this trial....he mentioned it on the audio on this site....listen to it....by CCToday....

I worked last night but my wife taped the program, Maverick, and I watched parts of it after work. That alleged audio evidence of gunshots was discredited years ago, which is why you so rarely hear about it anymore. Occasionally it gets re-dredged by journalists unaware of it having been discredited.

If you want the definitive account, read Gerald Posner's "Case Closed," which was published in 1993. Here's what the late, great William Styron said about "Case Closed" -- "I cannot believe that any rational person will finish Gerald Posner's book and still be persuaded that there was a conspiracy" involving JFK's death. McCowen has been framed....this is what I believe to be the truth. If I could solve the crime & point to the real killers for you, I would, but we have to leave that up to whomever. I do not profess to be a lawyer or have extensive knowledge of the law, but anybody with half a brain can figure out there is a cover-up here, & whoever killed Christa knew just how to mess up the crime scene bad enough so that the real truth would not come out. I heard something from Tarquin that Christa was seeing someone in LE and also a political figure.....I wonder who the latter could be....I know who the first one is.....& he was also seeing Linda Silva & she is dead too. Can this be proven?..probably not, but my source was pretty convincing..a woman who lived in Ptown for many years. believe what you want..

Think what you will of me Jack, but so far, I have been right on the marker with all of what Attorney George has brought to this case....I guessed early on about what he found out with regards to the sloppy investigation....

One more thing...why did it take 4 years to bring this case to trial...don't you think it was in the best interest of the D.A.'s office to prolong the DNA testing (12 months? give me a break)& when it's 4 years later witnesses forget a great deal..

Of course there may be fibers that are McCowen's. He raped her. What I cannot understand is the dismissiveness with regard to Frazier. This is a snick with a cop uncle, right?

You're welcome, Maverick. Not sure there were many people Hoover liked, for that matter, aside from his buddy Clyde. Hoover and LBJ didn't put a lid on the investigation as much as they accelerated it for the Warren Commission report to be released before the '64 election.

The historical context in which the assassination took place cannot be emphasized enough -- the height of the Cold War, little more than a year after the Cuban Missile Crisis. LBJ was rightfully worried that the American public's grief could quickly lead to anger and World War III if Soviet involvement was suspected, especially after it was learned that Oswald had once defected to the Soviet Union.

As I mentioned in another post I visited a club off the casino floor in Las Vegas 1964. The singers fame was her her amazing look alike to " M.M ". Sitting at the back table was Joe D. Which is good because you can actually attempt to empathize with another sign instead of just mowing them over. Maverick is Sun sign Libra with Moon sign Libra --- very fair and balanced but certainly not a push over. Teeter off of fair and balanced and he will fight to the finish on his beliefs. Much like our Sun sign with an Air sign, you have the same mix with the same gender attachment. Both signs are connected with active, assertive, outgoing energy.
