When he arrived, Patrolman Kenneth Gelnett found the operator of a 2000 Chrysler Cirrus later identified as 70-year old Shirley A. Gelnett had to break out the rear passenger side window of the vehicle with his baton, and assisted by an off-duty Harwich Police officer, Lieutenant Thomas Gagnon, who happened upon the incident they were able to immobilize her and open her airway.

The investigation into the accident revealed that the Ms. Dufton had turned onto Airline Rd. from Route 134 and had stopped approximately 75 feet from the intersection to make a U-Turn to head back onto Route 134. At this time a second vehicle turning onto Airline from Route 134 struck her in the rear. The second vehicle, a 2004 Dodge Ram pickup, was operated by 53-year old Thomas Hilchey of Harwich. Mr. Hilchey was cited for failure to use care in turning. Ms. Dufton did regain consciousness at the scene and was transported by Dennis Fire Ambulance to Cape Cod Hospital for her injuries. Mr. Hilchey refused transport to the hospital.
