"...no reasonable fact finder could conclude that the
officer in discharging his weapon... had an unreasonable apprehension of great bodily
harm..."
By James Kinsella
Cape and Islands District Attorney Michael O'Keefe has found that Yarmouth Police Officer Christopher Van Ness was justified in shooting and killing Brazilian national Andre Luiz de Castro Martins.
On the early morning of Sunday, July 27, Van Ness used his service weapon to fire at least three shots at Martins, who had been driving an automobile at a high rate of speed and who failed to stop for the officer.
Although Van Ness had stopped his cruiser in an attempt to block the automobile and gotten out, O'Keefe said Martins did not stop but continued to try to maneuver his car.
The district attorney said the officer had good reason to fear imminent great bodily harm or death from being crushed against his cruiser or run over by the automobile, and was justified by reason of self-defense in shooting Martins.
One of the shots perforated Martins' heart and a lung, killing him.
To convict Van Ness of a crime, O'Keefe said, the state would bear the burden of showing that the right of self-defense didn't exist, and must disprove that right beyond a reasonable doubt. Neither, he said, was supported by the evidence.
On the way out of the press conference DA O'Keefe was asked why he reported last year's theift of guns from his house to the State Police rather than Sandwich Police where he lived. He replied, "Grow up."
O'Keefe discussed his findings in a press conference held Friday at the Hyannis offices of the Crime Prevention and Control unit, which conducts investigations for the district attorney's office. A thick report about the shooting was distributed at the press conference.
According to the report, the incident began on the early morning of July 27, when Van Ness, who was on duty near Bayview Beach, noticed a vehicle traveling on Bayview Street at a high rate of speed.
The report said this is what happened next:
Van Ness got into his cruiser and pursued the vehicle, which he said was traveling at about 70 miles per hour through a 30-mph zone. He turned on his lights and siren to pursue the car, which ran a stop sign at Park Avenue and Glenwood Street. He radioed the station that he was trying to stop the car, a black Lincoln, on Harbor Road, heading toward Baxter Avenue.

"No, I'm going to run away.
I'm going to run away…
I'm not going to let them catch me." - Andre Martin
An officer in another cruiser heard the transmission, approached the intersection of Route 28 and Baxter Avenue, turned on her lights and placed her cruiser so as to be visible to northbound vehicles on Baxter.
Van Ness said the Lincoln braked, turned onto the lawn at 41 Baxter Avenue and continued to turn left, as if to reverse direction. Van Ness said he then drove onto the lawn and pushed the Lincoln from behind with his cruiser's push bar. The Lincoln slid away from the front of the cruiser. He said both vehicles then stopped.
The officer said the Lincoln came to rest facing him and the cruiser. Van Ness said he got out of the cruiser, stood next to his door, drew his weapon, and ordered his driver to show his hands and stop.
Then, according to the report, "Van Ness stated that the operator seemed to pause a 'second' and that he could see the operator's eyes and that the 'eyes had a crazed look.' The officer stated that, 'He gunned it right at me.' The officer stated that he took a 'step back toward my cruiser.' Officer Van Ness stated that he then thought, 'He's going to kill me. He's going to crush me.' He stated that at that moment, he was concerned that he was going to be crushed between the driver's side of the Lincoln and the cruiser which was to his right side.
"Van Ness fired his weapon into the driver's side window," the report states. "He then fired two more shots. He believes he fired a total of three rounds."
According to the report, the Lincoln continued southbound on Baxter, coming to rest 246 feet down the road.
A woman (Camilla Campos, who was Martins' girlfriend and the mother of his two children) got out of the car, screaming for help. Van Ness handcuffed the woman, told her she was being detained, and then looked into the vehicle, where he saw Martins gurgling and bleeding. Van Ness told the female officer, who had arrived on foot, to get a first aid kit, and then believes he radioed for an ambulance.
According to the report, Campos told police that she and Martins were going home when he said that someone was behind him, and that it was the police.
Then, according to the report, she said, "If it's the cops, let it be."
She said that he then said, "I'm not going back to jail," and stepped on the gas. The officer then put on his siren.
Campos pleaded with him to stop, saying it wasn't worth it. She said he told her, 'No, I'm going to run away. I'm going to run away… I'm not going to let them catch me."
She said Martins turned into a yard and hit a police officer. (At the press conference, O'Keefe said the blow was a glancing one.) She then looked past Martins to see an officer at his side, and then the officer shot Martins.
Martins was pronounced dead in the emergency room of Cape Cod Hospital. He lacked vital signs upon arrival at the hospital.
Forensic evidence shows that a bullet entered the left lateral back of Martins, and exited on the chest front. According to the report, the bullet perforated the heart and a lung.
Forensic evidence shows that a bullet entered the left lateral back of Martins, and exited on the chest front. According to the report, the bullet perforated the heart and lungs. An accident reconstruction report based on the location of the Van Ness's cruiser and the tire markings of Martins' vehicle said that the officer would have been within a confined five-foot space between the two vehicles when he fired the shots.
A toxicology report shows that Martins recently had been smoking marijuana at the time of his death. Campos said he had smoked marijuana earlier that evening and was smoking a marijuana cigarette during the car chase.
Of the two other shots that Van Ness recalls firing, one bullet skidded across the roof and wasn't found. Another went hit the rear window and was found on the rear deck.
According to the report, "the physical evidence is consistent with the operator veering right as he approached the officer and his drawn weapon. A natural human reaction is to turn away from the danger posed by the gun. As the operator veered to his right he exposed his left flank to the officer who had already committed to fire.
"The first shot hit him in the left side, penetrated his lung and heart, and exited the chest," the report states. "The second and third shots were fired after the car passed the officer. This entire sequence likely transpired in less than two seconds."
The report concludes that Martins was operating a deadly weapon, the automobile, which he was operating in a reckless manner without consideration of the lives and safety of others.
No reasonable fact finder, the report states, could find that the officer had an unreasonable apprehension of great bodily harm. To sustain legal proceedings against the officer, the district attorney's office would have to find that apprehension was unreasonable beyond a reasonable doubt.
"Therefore, there will be no further official action by this office in respect for this case," the report concludes.
During the press conference, O'Keefe expressed his condolences to the Martins family. He said he had spoken to Martins' father in Brazil and to leaders of the Brazilian community about the findings before the press conference.

Fear and Doubt Hang Over Immigrant Community Impact of Police Shooting in Yarmouth, MA
On Sunday, July 27th, Andre L. Martins, 25, a Brazilian immigrant and the young father of a 5-year-old daughter and a 2-year-old son, was killed by the first of three gunshots by Officer Christopher Van Ness in Yarmouth, MA. Last Friday, after eight weeks of investigations, the District Attorney's Office produced a report that concludes, "no reasonable fact finder could conclude that the officer in discharging his weapon after issuing commands to the operator, after observing the operator accelerate toward him as he occupied a four to five foot space between his cruiser and the path of the vehicle, had an unreasonable apprehension of great bodily harm. In fact, it must be proven that the officer's apprehension of great bodily harm was unreasonable beyond a reasonable doubt in order to sustain

Question: How is he going to be crushed between the 2 sides of the cars if the driver is coming straight at him? Did this car mover laterally? THEN, he fires through that side of the driver's car!!! Sounds like there was plenty of space between the two for this capability. Me? If he was that close and threatening and moving sideways(?) about to crush me, I'd be jumping up and over my car out of the way. He shot him going by.
Has anyone ever told you to SHUT THE ___
UP????
You are an empty barrel!! I bet the folks in Everett luv you
The poor thing is unemployable and perhaps our greatest comic relief since William Hung left American Idle.
You read what "4theinnocentaccused" wrote. So let's have some followup from brave Mr. Robbins the great PI. Easy to condemn the DA now that he's on his way out the door, where were you a few years ago Mr. Detective, when it mattered? Same goes for Manso--the no guts no glory writer.
The writing is on the wall. Let the retirement parade begin! Was the Police Chief in Eastham ready to go, or does he see the inevitable writing on the wall, too, like Judge Gary Nickerson?
But you small town minds would rather silence everyone in anyway possible, including the messenger, just to keep the lid on your obvious corruption.
Boohoo...cry me a freakin' river. Step right up, get those hot retirement packages while you can.....
But I agree with you. Keep the faith my friend. And slow down and enjoy the one life you have. This crowd isn't worth
all of your emotion. Save it for your family and beau.
Regards,
Jack
The truth will come out in the long run. Until then I just hope cru enjoys the precious years instead of bashing heads with the locals.

Obs is a new friend so please welcome him aboard with your light hearted sailors charm and quick wit.
Happy to provide the intro and Mav is a great guy...maybe you two can discuss some topics of mutual interest. He has always rushed to my defense and for that I will always be grateful.
Thank you for reminding the folk about the F-Bomb. Did it ever occur to you that as a resident of Winter Hill that I may have been alluding to the H-Word: you know, Hell?? Now, please be quiet, also.
Dog
Maybe that is why we have seen the rise in "in-your-face we can do whatever we want" mentality.
They do not serve us, they serve the United States Military. United States citizens have become the enemy. That's an exaggeration, but it is increasingly beginning to feel that way!
Interesting, can you give us some sources where you found this information?
Just look at a "conflict" anywhere in the world...the police force they send in look like cyborgs from a psi-fi movie!!!
We are waging a war against terrorism. During WWII there were active units all over America.
RE:
&*#This group hug$#!%,let's rumble.
That is unadulterated plagiarism!!! Shelli said that when she was booted!!
Happy trails to you, my man
Dog
chew on, go chase your tail for a while. Shelli wouldn't care if Ned used her line and the only reason she's outta here is because of that deputy PI and his thin skin. Still waiting on what he can dig up on van ness. Is it true what 4innocent claimed? He's responsible for sending an innocent man to jail who was set up by his brother and had help from MSP? Why would we not be surprised?
What we have here(besides a failure to communicate)is a group of citizens who despise law enforcement and the military yet would be the 1st cry for assistance once their services were required in an emergency...
Perhaps Kerry or Barney Frank will answer their call in lieu of such authorities..or even George Bush/Bill Clinton/ or the Chosen One..
Don't forget.
Once the " Messiah" apparently will become El Presidente/Emperor of the world..
the need for law enforcement will diminish and we can dismantle the despised military and allow the UN to officiate over our sovereign laws and law enforcement..
Better yet, since China now has a huge interest in our economy and holds the notes, perhaps they will come and protect us..hmmm
Can't wait!
For me..better to deal with the devil you know than the devil you don't know

The "old folks" pass on and their kids can't pay the taxes on a waterfront home.
UP FOR SALE. And in comes the Wall Street crowd with cash in hand.
They make Jeff Swindle look like an altar boy.
And the majority are democrants. But they don't look like Neddy. I wonder why?
When an uprising starts destroying businesses and homes,(now owned by the Chicoms) the Chinese will come in with the tanks as they did years ago..
After all, they control a sizeable interest in our economy and will obviously enjoy such an uprising from the great masses here in the US...
Plus it'll be good for the economy that the imperialist capitalists destroyed..
and one more thing..
forget anti pollution laws..
China is exempt
Who ya gonna call, then?
What law? It's become painfully obvious "the so called law", the majority, have shown the taxpaying public they are no better than the "low down crooks" they salivate over throwing in the dungeons for eternity even when they break the most minor infaction. Now they cry about the flagmen. What 90k a year plus detail isn't enough? Let me get the violins. MSP make 120- 200k, that's insane. Those days of wanting to be a cop to help the common citizen are over. Now we have a highly paid group of enforcers who answer to this criminal govt. and take whatever they want with zero accountability. Have you read the papers for the past two years? Boston pd and cape should bow their heads in shame and include the freeloading fd too. Not surprised to see what felon former statehouse turned radioshow host creep has encouraged this BS. Say THX to bulgers and FBI too. I'm disgusted. We deserve better and so do our hard earned tax dollars.
And puleeze...Obama is NOT the one calling the shots.
Someone on another forum said it well;paraphrasing, but it went something like this...
There are 7 billion people on the planet. Maybe 2,000 of them control everything. Of that 2,000, 1,000 of them live in the USA. The numbers are wrong, but you get the drift.
And if le and military are the muscle for these 1,000, why should we like it?
Why should we accept it?
And maybe you will understand this. Suppose you have a problem with the police, who can you go to for help?
DA? Nope. AG? Nope. Defense attorney? Yeah, but who's got the $$?
It's all rigged, so don't say we have to lay down and like it.
Hatred does not come into it. It's frustration and indignation. At least speaking personally.
Your 1st false accusation is the democrant statement..You are unenlightened and will be punished accordingly for your false and racist assumptions...
To even question a democrant is beneath contempt and obviously you are part of the right wing Cheney conspiracy..
You have no right to express any opinion outside of the dogmas instituted..
Besides..you have no "authorized" blog to validate any statements..
Watch out for military action against you !

All i say is this..
Much of what you post is correct and I don't dispute it..
Just don't implicate all from any service as the enemy..
Most are average folks like all of us here..
Much of what I post is in satire of all that is happening and has happened..
except the politicians...
Yes, DA'S and judges are political appointees that kissed plenty of ass..
I have contempt for 99.9% of em all..
Keep up the good work..
even though I do digress to agree all the time.
In satire..

I agree there are some very fine officers of the law out there, as well as loyal firemen who also put their life on the line for every citizen. But WHERE ARE THEY? If I was involved within an organization that had such heinous violators, I would be forming a line out the door in protest against their crimes. We read facts of their crimes for their involvement of: drug dealing, drug & alcohol addiction untreated while on the job, prostitution, domestic violence, illegal gun possession, assaults, destruction of state property (their vehicles)while intoxicated, conspiring to cover up a murder (in my opinion, not yet proven) breaking policies within dept's....the list is endless. What happens to these guys? They go out on adm.pay., retire w/benefits, disability..all under their union protection. I agree the politicians are the main problem. Look what a great role model your towelman has been for the past 8 years. He is no leader of integrity and honor,so what do you expect from the rest? Boston is no better, but at least we don't silence our media & the mayor wants drug tests.
For god's sakes, we have no money!
Please tell me how many are Democratic in Mass.
And who controls the Congress.
Thanks,
Jack
