Exclusive Interview: Marcus Miranda's brother at Cape Cod Hospital
Family Outraged - Three shots fired and two hit Miranda
Only allowed two-minute visit with wounded Harwich man;
Bullets still lodged in Miranda's crotch and thigh

During an exclusive interview with the brother of Marcus Miranda Jr. and a friend of 20 years, both requesting anonymity, there were more questions than answers as they voiced their outrage. Marcus Miranda is the 29-year-old man who was shot by a Harwich police officer September after the officer responded to a domestic violence call.

With a Harwich police officer posted outside Miranda's room at Cape Cod Hospital, the family was allowed a two-minute visit. "They shot him in the penis and the thigh", the unidentified brother explained. "What's up with that? Why didn't they tase him ?" (that is, use a taser, shown on right.) "I think there were three shots, one in the ground and two in him."
Police would not release the name of the officer who was involved to the family. The 20-year friend of Miranda claimed, "He would not hurt a fly, he is harmless!
"He has depression and supposed to be on meds, when I saw him the other day and he seemed OK."
Miranda's brother went on to say, " His girlfriend wanted him out of the house and she called the police. He didn't know what she told them and he was scared so he ran."
When asked if Miranda had a weapon, his brother said, "He ran and was hiding in the woods. They say he had a knife but they never found one."
The brother and friend went on to say , "His girlfriend Amber told the cops he never hurt her, she just called them to get him out of the house and scare him."
"He had run-ins before but nothing serious. The Harwich and Dennis police all know him, and knew he had mental issues."

When asked if Marcus had a history with the police, the brother said, "He had run-ins before but nothing serious. The Harwich and Dennis police all know him, and knew he had mental issues."
Family members explained that the bullets were still lodged in Miranda and he was scheduled for surgery today, Tuesday. Family also expressed their concern as they were not aware of any charges or bail, and questioned why he couldn't be arraigned at the hospital if there were.
As the family members were leaving, they commented, "This is a high overuse of force for someone the police are familiar with, and the police are not cooperating with the family members at all."
An attempt was made through hospital spokesman Dave Reilly to interview Marcus Miranda Jr., but through Reilly the request was denied. Direct contact through hospital switchboard operator resulted in an understandable "no calls or visitors" response.

In his facebook area Marcus Miranda (on right) describes himself this way; "I am a 29 year old man. I am in school for criminal justice. I hope to
some day own my own private investigation business to help people and
also find out who killed the rappers. LOOKING FOR A STRONG WOMAN WITH A
GOOD HEAD ON HER SHOULDERS THATS A GO GETTA.I am a romantic and work
hard I also cook clean oh and rap.I like football my favorite and base
ball."
Miranda writes that he works for McNamara Bros. construction in North Harwich where he is a foreman and is attending Kaplan University as a member of the class of 2012 and is studying criminal justice.

He also claims to be a grad from Cape Cod Regional Vocational HS in 1999.
He describes himself as single and interested in women. He lists and shows photos of 28 friends, all except a half dozen of whom are women.
His favorite quotation is "live by learn by and die by also pimpin."
The Cape & Islands District Attorney issues statement
Cape and Islands District Attorney Michael O'Keefe, who is charged with investigating police shootings, released a statement late Tuesday morning.
According to the statement, the "Harwich Police Department received a 911 call regarding a domestic disturbance on Sept. 29, 2008, at 5:59 p.m. from the alleged victim of that disturbance. Harwich officers were dispatched to the area. A responding officer observed the alleged perpetrator, Marcus Miranda Jr.... on foot. The officer pursued Mr. Miranda on foot.
"The pursuit led to an area near Willow and Belmont streets in Harwich," the statement continued. "The officer ordered Mr. Miranda to stop. A confrontation ensued wherein the officer discharged his weapon. Mr. Miranda was transported to Cape Cod Hospital, where he was admitted and reported to be in stable condition. He has been charged with a number of offenses related to the domestic disturbance.
"The case remains under investigation by members of the detective unit of the Massachusetts State Police assigned to the Cape and Islands District Attorney's office," the statement concluded.
Officer involved still unknown to public
Harwich Police Chief William Mason declined to comment on the incident or the identity of the officer, referring all questions to the district attorney's office under a standing protocol between local police departments and the DA's office.
No further comment was available Tuesday from the district attorney's office.

According to the CC Times this morning he is a registered sex offender, convicted of raping a child, history of domestic violence, assault and on probation for assault and battery on a police officer.
Now that doesn't make him a bad guy, family says he's been turning his life around (stop me if you've heard that before).
I'm sure the regular cast of characters here will come out of the woodwork to defend him.
I was referring to Martins being the cutie.
I love how one minute the cops do no wrong, the DA is a "nice guy, who you should go introduce yourself to, tell him you have been blogging about him, ask him what he thinks of it", and the next minute, the cop is in the wrong because he shoots this guy who is unarmed, then we look over his record and decide that it might be better to take him out back and end it all right there.
So is the DA really on his way out the door of his esteemed office and you guys are looking for the next coat tail to jump on, or have you decided not to decide and come back with more flip-flopping once again?
If they proved he is a sex offender, he should have done time for that. I think that raping a child is one of the worst crimes and have no tolerance for the scum who violate children. No punishment is great enough as far as I am concered.
I have issue with some people changing their minds based on supposed criminal records and not the event at hand. They are separate and should be addressed separately, therefore,your opinion is biased, Buzz.

Whatever the deal with this guy's past, why are the police so quick to draw guns and use them? It has happened quite a bit lately, hasn't it?

Raping with FORCE....get it bittersweet? That's enough to take your "innocence" away isn't it. And YES I do have a daughter and if it ever happened to her, a bullet in the penis would be the least of his worries.

All should to be educated about this issue pertaining to underage sex. Too many times do we see young girls dressing inappropriately in public. And we have men who cannot use restraint when it comes to demanding sex from girls/women.
It is a large issue and I believe parents need to do more about it. Boys need to be taught they do not have free reign over all girls (this can also anger and control issues with men)and anyone who is a minor is A MINOR! Against the law! Two wrongs do not make it right. My own children were moved into Catholic School by the age of 9 because girls were dressing "slutty" and I refuse to allow my daughter to dress that way. I've also taught my son and daughter about "the birds and the bees" and then some as how it applies to the complexities of our wacked out society. Look at all the porn out there! What is on TV! I blame it mostly on our media and internet for pushing sex,sex,sex. It's just so out-of-control nowadays. So much hyposcrisy. Education early is key--put it in the schools if parents can't do the job. More jailtime.
Rape is a control/power issue for the perpetrator. and technically not even really a sexual issue at all. It was forcible rape! It wasn't even ANYTHING having to do with her no matter how much Cru and bittersweet try to blame the victims. She could be running down the road naked and you know what? NO-ONE has the right to jump her. NO ONE- especially an adult.
As far as underage sex as I know it-see above in this post for description: Boys and girls both need strong information about their bodies and the opposite sex. Sure we can cop out and just blame the media for a blase society- but it ALL begins at home. We are the most important educators our children will ever have- And nothing about sex, puberty, the opposite sex, self esteem and self respect should ever be taboo or unmentionable to us. If we don't instill self esteem and knowledge the why's and what's of society and life to them ourselves then we have failed them more than they can ever fail themselves.
That is an insult to all women and girls who have been truly raped.
Did you not read of that carnival worker who had sex with a girl who lied about her age, lied about the incident, and he had to spend weeks in jail?
THEN, when a true rape occurs, the onus is on the woman to PROVE it.
Any young girl who lies about rape needs to be held accountable, and the young men who are involved in a consensual encounter do not need to pay for it the rest of their lives!
Everyone needs to take PERSONAL responsibility for their actions. If the girl was leading the guy on in anyway, he still should have just backed off. Rape is rape, consensual sex is consensual sex. Maybe they should outlaw sex of minors until they are 17 years old. If caught, they should have to spend a week or two in a sex education class and taught about STD's. I'm not blaming the victim. I'm merely pointing out there are always two sides to every story and the truth. I've seen my own share of how young girls and women manipulate boys/men and get away with much. If girls dressed as girls, maybe they wouldn't have to beat them off with sticks. Everyone knows that there are many boys/men out there that don't think with their brains. But our lawmakers should have stiffer penalties for predators who violate young children. I think they are the worst form of scum in our society.

NO surprise there are very few FACTS that come out of Cape LE. Vested interests and all...you know. They always paint perps darkest color it makes them look better, the same for Martins. If the 18 yr old guy raped her, then he should be in jail. How much time did he do? If the girl has no parental supervision & is free to have sex at such a young age, well that is unfortunate. We as a society should be doing more to educate our children about how to respect their bodies. Poor choices at an early age, make for mistakes unchanged later on in life. As a parent, I've watched both be ridiculed for not "going along" with the rest. Luckily for me & them, no unwanted pregnancies, rapes, or multiple partners, & whatever other deviant behavior is going on in the world today. After watching my kids go through parochial schools, are not much better. In fact, they are worse, because the "better than thou" crowd have no clue what their straight "A" brats are up to. Once my son walked in on a naked girl in his apt., daughter to a cop. He told her "not the playboy mansion get the _ out".
I'd allow most cops and LE into my house anytime over these scumbags...
At least they are civilized!
