The Mortgage Bomb Keeps Ticking

Well; it seems as if the feds are just beginning to understand the meaning of predatory lending.

Today, the NY Times reports (nytimes.com/reckoning) on the investigation by the SanFran US Attorneys office into option ARM loans called "Pick A Pay" that were originated by World Savings bank. Interestingly, many of these time bomb loans were originated right here on our spit by a now defunct mortgage company known as Hyannis Mortgage. How do we know this? Because we have been contacted by victims of this bank and mortgage company.

Calling the loan the Typhoid Mary of the mortgage industry, the loan allowed borrowers t0 pick a loan payment that did not even cover their interest charges. That resulted in negative amortization, i.e the increase, not decrease of the principal. Add to the mix decreased housing values and you truly do have a ticking time bomb. Our office has actually worked with a specialist in mortgage loan audits and we still can't figure out all the ways that the mortgage would work in certain circumstances. It is, in many respects, incomprehensible. An attorney in California representing some elderly mortgage holders calls the loans" the most destructive financial weapon ever deployed against the American middle class."  In fact, on the Cape, the victims traverse the economic spectrum. To make matters worse, most of the loans contained a three year prepayment penalty, which prevented many borrowers from refinancing once they understood what in the world they had actually signed.

There are currently almost $1 trillion in Option Arms out there and Wells Fargo (which bought Wachovia, the company that wrote many of the loans) estimates losses of $36 billion on the loans. The time bomb keeps ticking!

Many readers will certainly be critical of borrowers that took out these loans and loans like it. However, one thing we have learned in the course of handling these cases is that the companies trained salespersons and brokers to sell these loans. As the Times reports,  professional hucksters were taught how to pitch the  loans and deceive even the most savvy consumer.

The subprime wreckage continues; despite the efforts of our legislators and regulators.

Loan sales are extremely aggressive and, without a lawyer with expertise, the average savvy consumer was hoodwinked, and still today.

Trouble is, the govt and attorneys general have little to go on now that the damage is done and the monies gone..
and given the insider sweet deals, who's to trust the govt anyways?

They've bailed out their cronies with our money(without it there'd be no money)and left the average homeowner on the street..."a fine mess you've got us in this time, Ollie"*

These banks are now touting 5.25% fixed loans, but ask the average homeowner if they'll even qualify for the loans.

most haven't..banks are holding on to the free money given to them..thanx to Uncle Sam, and spreading their holdings and portfolios..not loaning the monies as appropriated to small business and homeowners..

This time ALT-A and Option ARMs.

Many fail to realize that there are millions of self-employed smaller businesses, who employ from 1-10 employees, that are holding the mortgages that are going to reset in 2009 through 2012. These borrowers are Prime and Near-Prime borrowers who hold ALT-A, Option ARMs, Interest-Only mortgages. There are $1 Trillion ALT-As, and $500-600 Billion Option ARMs.

So, here we have a major problem… Not only will these small business owners lose their homes, but there will be the resulting JOB LOSSES on their business failure. Note, although President-Elect Obama is stressing the need to create 3 million new jobs, we must understand that “JOB RETENTION IS AS IMPORTANT AS JOB CREATION”.

According to this survey, it is estimated that 3,709,800 small business owners hold Alt-A and other toxic mortgages, and 1,279,800 are already delinquent as they have missed one to three or more monthly mortgage payments.

Host said, "when a welfare mother steals $60 bucks they run it in the paper for a week and want to execute her!...but these guys get bailouts?". It's toxic from many fronts.

Now the lawyers are making money on the exploited, down and out homeowner who must pay once again for mortgage litigation, which is pointless, and or bankruptcy. What a country. Hope the dirty dogs tank. They are nothing without the backbone of the hardworking middle class. Nothing.

Gonna quote something, get it right. It was every 50 years, not 200 (began on 10th day of the 7th month of the 50th year), and it included other features, including: (a) being forbidden to prune, harvest, or plant trees (like Sabbatical years, see discussion below), (b) slaves were freed in a complicated formula of returning home, (c) land reverted to its "hereditary owners", except houses of laymen within walled cities, (d) the Jubilee Year was an extension of the Sabbatical Year which was the 49th year. The leaving of land to be "fallow" every 7th year (Sabbatical) and during the Jubilee was deliberately designed so that the poor and folks who otherwise could not feed themselves could gather and eat the crops which would inevitably spring up on the land nevertheless. Moreover, there's a prohibition, when harvesting, upon harvesting the corners of lots of lands every year, so that the residue there could be used by the poor for the same purposes.

The practice of Jubilee and Sabbatical ceased when people stopped living as tribes in the original land.

Check out the headlines (Bloomberg report), Bush holding hands with mortgage scammer, wonder how many others accepted dirty money off the backs of unsuspecting homeowners. The claim is he gave a mere $28k, lol, is that all it takes to get pardoned by the president. Liars! Did he get all his debts paid? Or is he running off with the taxpayers store? They all deserve to go down in flames. Maybe we'll get lucky and he will move to Paraguay with daddy from the CIA.

It's great you are helping clients keep their homes. Many mortgage companies don't have the steam they had last year to foreclose. They are over-burdened with too many late payments, which means many are going under. It's about time. An attorney at Hale & Dorr, told me that the lenders are selling at a 30% loss to other banks instead of providing a modification to the borrower, although many do qualify. That bank will sit on the property until the economy turns around. They have no intentions of lending money to buyers. Maybe only to those qualified to pay cash with 800 credit score. LOL. That is a big help to those looking to save their home, or buy at a bargain rate. Interesting what you learn from laywers who have been fighting to save the helpless homeowner. Have you joined the congressional panel too, like they have? It will be interesting who they sell the homes to, maybe China & whomever else this crooked president owes money. They have loads of rich Middle Eastern & Chinese who are on the foreclosure auction party bus. So when do you predict the next scam? Or have the American taxpayers had enough, yet.
