Dennis Police investigation results in second arrest for Indecent Assault and Battery

UPDATE: According to the Dennis Police Department, Macaruso is being held on $50,000 cash bail for the new charges of indecent assault and battery. His previous bail from the August 7, 2009 arraignment has been revoked. He is due back in Orleans District Court on Wednesday, October 28, 2009 for a pre-trial conference on both cases. Additional charges agains Macaruso may be forthcoming.

DENNISPORT - At approximately 9 p.m. Sunday evening, October 25, 2009, Dennis Police arrested Richard C. Macaruso (right), 58, of 78B Upper County Road in Dennisport on charges of three (3) counts of Indecent Assault and Battery on a Person 14 Years or Over.

The arrest is the result of a five (5) day investigation initiated when staff from Cape Cod Hospital reported the possible endangerment of a 14-year-old boy.

In cooperation with personnel from the Department of Children and Family Services and Children’s Cove, Detectives Christine Hornby and Patrick McCaffrey conducted an investigation which culminated in Mr. Macaruso’s arrest.

During the course of the investigation Detectives learned that two of the alleged assaults occurred at Mr. Macaruso’s home and the remaining at his place of business F.I.T. Games (697 Route 28 Dennisport) a “gamers” store catering to mostly teenage boys and young adult men. 

Mr. Macaruso was held, without bail, overnight at the Dennis Police station for his arraignment in Orleans District Court on

Monday morning.  Mr. Macaruso is currently released on cash bail for an August 7th, 2009 arraignment in Orleans District Court charging him with similar (unrelated) crimes.

Police are continuing to investigate and ask that anyone with information contact Det. Christine Hornby at 774-352-1517 or chornby@town.dennis.ma.us.

This guy reopened his store the day after his arrest in August! Even more incredible is that parents still allowed their kids to go to the place. I work nearby and see young boys going in there all afternoon! Sick stuff...and idiot parents!!!

I have been a patron of the shop for 3 years. I take my son there and we play card games. As a grown man and a parent I can say I never...ever...saw this man touch, tickle, prod, poke, or so much as flirt with anyone. He does kick kids out of the store for bullying, stealing, bad trading, and such. When I go to the card shop, I stay with my kid only beacuse I, too, play these card games, so I'm there for 5, 6 hours or more, and I have never seen any lewd or suggestive behaivoir. In his home?...i cannot say, but at the store he is always nice.

I am a gamer. I have been playing magic since i was 14, and now at 28, i will be playing the game as long as it is produced.

As a gamer and a father I find this sort of behavior just as despicable as every one of you, but I'm not so sure in this case that I can stand with the outraged. see I, being a gamer, have had the chance to frequent this mans shop on more occasions then I can recall, I have played in his Friday night magic tournaments , where I have had the ill fortune of being beat at a game of magic by a kid not even old enough to have a learners permit. Not once have i seen this man be sexually inappropriate,a temper and burst of questionable language maybe. I'm just speaking from my own experience... I wasn't there when these alleged incidents occurred.

To have commited this crime while out on bail from the August arrest...this guy is a monster out of control! 20 years ago I gave him a ride home from work and he had a 15 year old boy running around his house with no shirt on...I knew he was up to no good when he opened that store.

I spent hours there playing games. I am 40, a professional man who wears a suit and tie to work yet I also like to play card games with my son and other people. does that make me a loser? because i can enjoy a card game with my son and others i'm not right with you? time for you to join the real world, the one where a real man does not need to watch football, drink beer, and get in fights to have fun. it was always fun to be at the shop--lots of people to play all kinds of games with, the rick and roll playing over teh store's music system, the pizza and drinks we would buy, the friendly comeptition of games like magic, yugioh, warhammer and others. i saw more than one ticked-off teen be booted from the shop for bullying, taking advantage of other kids via bad trading and sore-losing. rich was friendly and i can see all too easy how it would be easy to peg him as the bad guy, and pin a molestation wrap on him. all you had to do was say "boo"--he works in business where parents come and dump their kids for the day.

ccdude...nobody is saying that you're not right to play cards with your son. At the same time remember that you can't stereotype others i.e. your comments on football fans. When you play cards you're escaping to a fantasy world. FYI football is in the real world, not a fantasy card game. On another note, this guy is in a business where he is around kids, all the more reason to be more carefull on his part. And parents who drop their kids off at places like this...what are you thinking?
