Doctors and Drug Companies
Disclosure: I have litigated many cases against big pharma. In fact, in September, I have a trial starting involving the alleged negligent administration of anti-depressants, resulting in the suicide of a 55 year old cape mother of 4. Therefore, I admit, in advance, that this is not an issue in which I can be perceived as completely objective.
In today's Boston Globe, there is an editorial which discusses the importance of physicians receiving "unbiased" information regarding pharmaceuticals as compared with the "sell" they receive from drug company reps. Thankfully, Massachusetts has strict rules regarding the "interaction" between pharma reps and doctors, and bans gifts to physicians. Further, companies are required to report any payments to doctors greater than $50.00.
In addition, there is a state funded program wherein state representatives are sent to community health centers to provide unbiased information on diseases, clinical trials, and treatment options. Doctors are also instructed on the risks, costs, and effectiveness of pharmaceuticals.
Those readers that know that I am the President and Chair of OCHS would be expected to ask whether or not OCHS has a policy in this area. I am proud to indicate that, under the leadership of our CEO, Sally Deane, and our Medical Director, Barbara Prazak, M.D. , such a policy has been implemented, and it is a simple one. No drug reps; no samples. We do participate in the above mentioned program. Obviously, doctors need continuing medical education on drug research, but as Sally has stated, "where and how they get their information is key". In addition, our physicians are encouraged to prescribe generics whenever possible.
For those interested in exploring this issue further , Sally Deane highly recommends a book written by a colleague, Marcia Angell, M.D. entitled "The Truth About Drug Companies-and What to Do About It".

Attorney Bierhans has been practicing law for 28 years. While attending college at UMass and Suffolk Law Stchool in Boston he was an aide in the Massachusetts Senate and worked for former Cape and Islands Senator John F. Aylmer and later for Senator Joseph Timilty. He started a trial practice in Stoughton in 1982 and was a partner in downtown Boston firms from 1988-1997. In 1997, he left Boston to form his own firm in Stoughton. Bruce and his wife Nancy moved to their dream home in Wellfleet in 2000 and he now has offices in Chatham, Wellfleet and Easton.
