Glitchy, Glitchy, Goo

By Jeff Blanchard

Massachusetts had about 2,600 serious police cruiser crashes, 500 in which a trooper could have been punished as the responsible party, but for "a glitch in the system."

T

hat was the state's top cop, quoted in a recent story on how, when state troopers smash up their cruisers, they often get to investigate themselves... and how, over a three-year period, Massachusetts had about 2,600 serious cruiser crashes, 500 in which a trooper could have been punished as the responsible party, but for "a glitch in the system."

But is "glitch" the right word for it? Or is this business of self-policing more typical of a larger problem in which our system of checks and balances has broken down and needs emergency roadside assistance?

A Fish Stinks from the Head Down

On Cape Cod, where the first thing you learn is that a Fish Stinks from the Head Down, it is often argued that the Bar of Acceptable Behavior for a Public Official was set on Martha's Vineyard one night in 1969, when our senior senator got liquored up and left a woman to drown upside down and gasping for air in his mother's submerged Oldsmobile.

In any event, where some see a glitch, others see a system in which self-policing is the norm, just the way things are with criminal justice in America today.

Here on Cape Cod, for example, District Attorney Michael O'Keefe:

  • Is heading the investigation(s) into a series of break-ins at his house at the Ridge Club in Sandwich, the first last December, then another in recent months...without results, so far...thus, no word on the whereabouts of the district attorney's missing guns, or even what kind of guns they are, and whether the public should be helping law enforcement in looking for anything specific, or loaded.

da55_80Now, it could be argued that the state police are conducting the investigation, or the Sandwich police are conducting the investigation, or the Sandwich police officer who runs the security for the gated golf community is conducting an investigation, but they all answer to one man, the presumptive owner of the missing guns. Is that a glitch?

  • Conducted the investigation that cleared Ann Gryboski in the self-confessed shooting death of her husband, Patrick Lancaster, on Easter Sunday, despite that O'Keefe and Gryboski were neighbors and immediately after the shooting he declared her a victim of mitigating circumstances.

dr.gryboski55_85_01Now, it could be argued that she did face a grand jury, but of the 27 people called to testify, none were among that group of immediate neighbors who wished they had been. As for Gryboski, she surrendered her medical license after the shooting and has yet to have it reinstated by the state medical board in the eight months since. Is there a glitch here?

  • Prosecuted the Christa Worthington murder case, despite having made prejudicial and widely-publicized pre-trial comments about the victim to Maria Flook, a Truro local who was writing a book on the subject, Invisible Eden, a blend of pulp fiction and hard-boiled hallucination. Highlights included a passage where Flook arrives at O'Keefe's house (the old one near Gryboski, not the new one at the Ridge Club) just in that interval of time between his outdoor shower and his splash of cologne, the two of them soon off to cocktails at the Sons of Italy, not a glitch in sight.

mccowen55_70Now, it could be argued that Christopher McCowen deserves to be in jail, but our faith in that fact would be a lot stronger if the case had not been brought by a guy who would characterize the victim as a slut in a book published before the trial...who was not sidelined by his comments, but allowed to build a murder/rape case with no murder weapon and no evidence of rape, on a Million Little Lies told by the Gang That Couldn't Shoot Straight, on DNA that proved nothing of guilt, with a medical examiner who could not continue (for medical reasons), in front of a judge who could not continue (golf cart accident), in front of a juror who could not continue (cell phone call during deliberations), on the basis of a six-hour interrogation that was not recorded, but packaged and distributed as a 27-page confession by a state trooper). Oh, and the courtroom arguments were handled by an assistant district attorney who would no longer continue, either (and instead joined the family business as a third-generation judge).

  • kellynolin85_190Prosecuted the Jonathan Wessner murder case that sent Paul Nolin to jail for the crime but resulted in no charges against Nolin's boss and alleged lover, a Catholic priest named Bernard Kelly, who once worked at the Kennedy family's church in Hyannis, St. Francis Xavier, along with the priest who got Nolin sprung from jail years earlier, Donald Turlick. During the course of the investigation, it was revealed that Kelly had stolen $1.5 million from various churches within the Fall River diocese, but instead of following his friend and church handyman to jail, Kelly was allowed to make amends and flee Cape Cod. Where'd he get the $1.5 million to pay back the church? By selling his Cummaquid estate, complete with horse stables and a swimming pool, to the Humane Society of the United States. By contrast, a Catholic priest in Darien, CT., recently was convicted of stealing the same amount of money for the same purposes in the same manner, and he got jail.
  • da55_80_01Decided this week after a public outcry for justice that state police should investigate the fuzzy videotape case concerning John Reine, a Falmouth man accused of slashing someone's tires. Surveillance video that allegedly captured the scene was not introduced as evidence because of some malfunction that occurred while the video was either in possession of the district attorney's office or defense counsel, it has yet to be determined conclusively. Asked by a reporter whether he would call in a special counsel to review the matter, O'Keefe told the paper he would not "because it doesn't come close to rising to the level of a circumstance where that would be appropriate."

Just another glitch, that's all.

from CapeCodTimes 2002 article:

"Asked about his prosecution style, he said: "You've got a limited amount of resources to bring to bear on this process of criminal justice," said O'Keefe, who said most crimes either fall into the category of "human frailty" or "genuine evil."

"Use a little compassion when it's human frailty. Use the heavy foot of the District Attorney's Office when it's genuine evil."

...so, I guess he figures he gets to decide.

Jeff,

This is by far one of your very BEST! YES...those MSP cruisers crashing into trees, rear-ending cars, those high speed chases allegedly to save someone, but forgot to put the lights on, and siren..putting one motorist in the hospital, one on Great Western Rd., just recently another I heard in Boston, co-worker's sister, but never did read the conclusion. Do we ever get to read about any of these stories? I'm shocked they get printed at all! Why not do away with all the newspapers entirely if they are continually censored by the DA....with no explanations given, other than "it's being investigated"...yeah, right..the all too familar phrase that is worn out.
So not only are we up to our eyeballs in paying for the bigdig, but think about all those pending lawsuits by those hit by the glitches in the roadway...don't these guys get special driving lessons?

Come on will ya, yes I think you are the great gadfly...there I've said it. now you can tell me you are not, & we'll have a long lasting dualing match over it...but not tonight I have a headcold that is killing my focus, so maybe tomorrow.

Newspapers I suspect censored by the DA: CCTimes & CCodder, but not as much as the Times.

CCT: For tourists who wish to read watered down journalism to the point it's like reading, a home ins. policy--dull, duller & dullest...I like some of the stories, but an easy sell to the seasonal tourist who only wants to read the national news & local vanilla.

CCodder is better..it reads like a Peyton Place novel...who's screwing who in terms of business deals gone bad, cutting of trees for better shoreline vistas, who's at fault, the cement stairs to long pond debacle, building & land disputes by second home owners who are told after they buy, they can no longer build, Flemings vs. Dunkin Donuts saga's, D & D in Eastham can't heat muffins..LOL..stil can't get over that one.

Ptown Banner earns my respect, it's fair & honest.

Marilyn Miller has done a fine job at the Codder covering the Christa story & heard she goes for the throat, not afraid to tell it like it is, but even Marilyn has had her difficulties with the Truro gang in terms of getting the facts--according to a selectman on lower Cape...calls to the editor were threatened if she didn't back down....I can only assume the editor and DA make certain decisions in terms of what gets printed in the Cape papers...because of course--if the story doesn't make it in print, there is nothing to dispute at a later time. HELLO....

Ptown Banner is he only paper with the bite to print the story of David Costa taking the stand on Monday, the last day before deliberations. I wondered why that went to print, since we all know Dave didn't have to testify...maybe chiefy made a few calls that saved Dave from the hotseat...that was later reserved for chiefy at townhall about the missing funds...CCodder did cover that one....good goin'...to bad Lucy couldn't get the chief to disclose his expense account...see they all take lessons from the towelman...shhh

Once again it goes to show how ill informed you are and lack any credibility. I asume your speaking of GG Peter Kenny? No, I am not him. How can you make a statement that the DA "censors" newspapers and not back it up? That's a serious charge. That shows me just how dangerous you are at starting rumours without an ounce of credibility. Why don't you call the newspapers and ask them if there being censored and post their response here. I remember reading your posts when you were leaving the Cape and how bitter you were at all the people (especially men) you blamed for your failure here. You left and you just can't let it go. I spent many summers on the Cape as a young girl with family like others have. 5 years of trying to live there full-time & seeing what really goes on in your sub-culture that is condoned by your public officials you pay turned my stomach, so I moved away. I was treated like an outsider, like Officer Busby, Christa W., & probably a lot of other people that chose to move & remain silent about their bad experiences. Alternative views or ways of life is not accepted, that is clear. Maybe if the Cape could change & accept outsiders problems like this wouldn't happen. You empty the pockets of innocent elderly & other newcomers because you have zero economy. When all their money is gone, they are stuck there. I was lucky enough to have a place to return to. You think by trying to humiliate me on this site, I will go away. YOU ARE WRONG.

But, the reporter from the San Jose Mercury News who exposed the story ended up dead...just as the biochemist(i think) who exposed the "sexed up" information about the Iraq war suddenly "committed suicide".
Maybe reporting the truth is just too life-threatening.
And it seems the same kind of threats, or something,??? has happened in the Worthington case...people have left the Cape for SOME reason...but only the people who believe Chris is innocent, or who believe some rotten/criminal stuff happened in the course of this murder, trial and conviction. That is not exactly a glowing tribute to Cape Cod, or something that should be tolerated. What made those people leave?

I want the truth for Christa, as much as what she allegedly did during her stay on Cape Cod, I wager that others have done far worse. DA shared evidence, & slandered her before the trial.

Since I've been writing about her story, I too have been branded --"accuse them of being crazy, no one will believe them, eventually you break them down, they will simply go away." No, not this time. Christa's story will continue, with the motions & hearings that will be presented in court regarding claims of racial bias & suppressed evidence by your DA's office. Evidence in Busby's case, suppressed evidence.

When the truth finally gets out about who the real killers are--what could you possible say then? It's the same sheer arrogance, abuse of power that has got your DA in the hot seat now, with story after story questioning his abilities. Now there is an OPINION piece in the CCTimes asking for AG intervention because people don't trust the involvement of the MSP with the latest J.Reine's case of the strange events surrounding the video tape.

Ignoring the problem is accepting it.

But as soon as freedom of speech is exercised and does not go along with the DA's office, it gets wiped out. Why did it happen? Was it just another one of those glitches? Must be....under the discussion forums of CCTimes, I've seen no other comments wiped out...only McCowen's story.

So don't tell me that stories don't get censored, they do, & it's all about keeping the pretty picture in tact of what the chamber sells to tourists. It's abundantly clear that C C wants it all--but tourists want their money's worth, so do the second home owners, retiree's & those who choose to move there full-time. If the locals want to keep Cape Cod all to themselves, then throw all the washashores out, along with the tourists, retiree's, take the bridge down. Learn to survive on your own if you can. Accept the trophy home owners let them treat you like second class citizens. They can afford to have their services flown in from elsewhere & probably do. Must be another strange coincidence, yet again.

Maybe you could call Officer Busby from one of the 11 states he's moved to and tell him he's crazy too, that what happened to him in 1979 he brought on all himself because he made the mistake of trying to do his job and stand up to local criminals who also owned a large business and used it as a strong hold over the PD and DA. And how's this Buzz...this is what I believe certain local police, state police, the DA, the prosecuting attorney and the judge are guilty of in the case of Christopher McCowen. Just my opinion mind you, formed over the course of reading many blogs about this case, and my own gut-feeling.And knowing Chris personally.
1. False Imprisonment
2. Lying Under Oath
3. Obstruction of Justice
4. Jury Tampering/Jury Nullification (not sure what that is, but get the jist of it)
5. Viloating 6th Amendment...He did NOT have an impartial jury. Racial Bias is obvious.
6. Judge was not impartial. Favored prosecution.
7. Violating 8th Amendment..Extremely high bail.750 million dollars.Fellow admitted murderer had 5 million bail, got out on 500,000.
8. Suppression of evidence that would have a serious effect on the trial.

I'm sure there's more, or others that I missed, but from my limited knowledge, that is my opinion about it.

And I believe someone was threatening those jurors who thought Chris got robbed of a fair trial.

He rots in jail

Well thanks for clarifying your comment. However, I'm a little skeptical that you formed some of your opinions by reading blogs. Until then, he was tried and convicted in accordance with the law. He is a convicted murderer.

Lastly, I do have a heart. I feel pain and sorrow for Christa and Ava. Merry Christmas.

It is YOUR axe, you prefer murderers and rapists; you're such a good person, counsel the murderers and rapists. It won't help, but go right ahead.

wavemaker, Do I have an axe to grind? Possibly, because I have to be in court for the next year-and-a-half, instead of living my life. A rapist, who was let out of prison without having served his time.

Did Kerry-Healy lose because of a poor PR campaign against Cadillacman pardoning a rapist? That rapist PR ad was awful, and turned a lot of people away from her campaign.

Your hatred for LE is unwarranted, and is not helping the case for a new trial.

Not because McGowen is innocent. He is an accomplice to rape and murder, at best.

He is where he should be and should remain (they don't even have to work in Walpole; best job he's ever had).

Will the criminal attorney persist? Not for McGowen to be released, please, God, even he couldn't be that stupid, but to indict the second killer/rapist.

But, that does not give me the right to take out my anger on innocent people. Chris Mccowen had a "relationship" with CW on Thursday, and that was it...end of story. He does not belong in prison paying the price for some other people's crime, because he is black, and they knew they could sell this "big bad scary black" thing.AMONG other dubious and highly UNBELIEVABLE circumstances....NO evidence at the scene? The big bad scary part in my opinion is that we have "law makers" who are willing to break the law in order to protect their own (in whatever respect that may be).
