Regarding judge's appeal record, check out the public site at http://www.ma-appellatecourts.org/search. Search by judge's name to find history of appeals on any judge.
It's more frightening than sad that power-hungry judges and D.A's find more (self) importance in accumulating convictions than administering 'justice'.

Hey magician,
Always seem to be lots of unanswered questions when the DA is involved.
Do you think if this happens to Doris at the donut shop who makes 6 bucks an hour, who the DA wouldn't ask the time of day, decides to take out her sawed off shotgun, blow her husband away for 20 yrs. of abuse, the DA will feel compassion & get her off the hook? How many victimized women who killed their abusers are doing hard time in prison? Maybe Annie bang-bang can start a fund for those women in jail who didn't get the same courtesy by grand juries or jury panels across America. How about she donate some money to Victims of Violence, build a quality facility on Cape Cod, next to her practice, better than that broken down shack they call the Independence HO-BO House--the place looks like it should be condemned. Guess they care so much about abused women, the DA & doc can't put a community together & help the other thousands of women on Cape Cod fleeing from their abusers...oh, that's right, it only matters when it's the beautiful people who get in trouble..silly me, what was I thinking.

Hey clamshelli,
Nurse Hatchet wants to know what you've done to make it better? Like some people in and out of this story haven't tried. The dead rat in Weinstein's boat reminds me of the horse's head in the bed. So many stories, and yet nothing gets done. Who are you going to complain to when it all falls on deaf ears.
I wonder if the doctor can sleep at night. And the DA who should have done the right thing and referred this case to Plymouth County were there could have been a fair trial--she doesn't have a practice there, and maybe his grip is not that far reaching. A trial at the very least. And if her husband was really shot 4 times--why? Was it a sticky trigger. Maybe if people found that out, they would question why it took so long for EMT's to arrive. What time did she call 911. Did the DA show up there first? Conflict of interest. Of course he knows her personally, she's a prominent doctor in Hyannis, they probably rub elbows w/same crowd. What did Lancaster know, that was going on with his wife? He was off Cape 4 days a week, plenty of time to make friends.

She's also done a complete makeover in looks...housefrow to blonde girly-friend...? No trial? Lancaster's brother was interviewed & told a different story. Pat Lancaster was working out of state four days a week...plenty of time for wifey to make new friends....more unanswered questions that won't get answered...the beautiful people can get away if they have the dough, the clout (daddy Gryboski & his friends) and a powerful DA. Shame on the Board of Medicine. That is the very least she should have
to pay with-- her license. But maybe CCH is now in trouble and also needs her, too. I'm totally against violence towards women--children, men, elderly--no one should tolerate abuse. It's up to our judicial system to sort it
out. I believe her and her husband were involved in a dysfunctional relationship. It takes two--she should have got out--plenty of women do. Her husband held no weapon. She had no trial. Something is wrong with
this picture. Anywhere else in America, the woman would do time--you know it & I know it. Class has a lot to do with this outcome & the DA enjoys his towels.

Facts kept from yet another case manipulated by the DA? Neighbors wanted to come forward and were told not to by the DA, both family members were under strict orders not to talk to the press. How many times did she shoot him in the gut? Were AG & the DA neighbors? Some
claim they were. Yes, she had bruises but he had a walker and only holding a tape measure in his hand. She had options--DIVORCE & a career & powerful
daddy to help her out of a bad marriage & bad situation. No one deserves to die that way--abuse or not--he had NO WEAPON! NOT EVEN A TRIAL? Guess she really knows how to buffalo the unsupecting elderly who don't know the other side of AG as stated by family of Pat Lancaster who know her better. How long before the EMT's were called...how long did she wait? seconds, minutes, hours? Was it really the son, and she covered? What relationship does she have with Mr. towelman?Where they seen holding hands at a pub on lower Cape? Has he got career aspirations to be the next US attorney because the Cape is all used up. cont.

Yes, and the good ex-wife defended the towel wearing DA against floozy flook...what a place. I'm afraid your outnumbered by the mobsquad and writer who helped covered it all up. They just made more drama to deflect the real story. All eyes on them and not the case.
Can you explain what you mean about 70 appeals--with regard to what type of sentencing? Guess she's helping her ex rack up those convictions. Maybe he too will be bucking for an ATF job someday.
And we worry about petty theives running around. It's certain people in power we must fear. They need to be exposed before they do more damage.

And, isn't Judge Joan Lynch (sitting in Barnstable District Court) the ex-wife of DA O'Keefe??? Does anyone else think this stinks too? Nepotism at its best - or worst. She's a former ADA with over 70 appeals filed against her. Compare that with judges sitting in Barnstable far longer than she has.

Well Jeff, if you thought this Yarmouth debacle was a sham...
You shudda been @ the Boston MMS hearing... FYI: On film as is Yarmouth's.
Member after member -In your face- SOS banners around their neck...
Unabashedly strutted up to the microphones stating they were there to read statements for public official after public official...
Had to be at least a dozen of them.
So obvious was it each & every statement was crafted by the Dal'liance's professional 'public relations' staff...
Note that these "Public Officials" being represented by this cabal had 3 minutes (and 2 for 'the public') to tell their tall tales...
They purposly delayed/eliminated testimony of legitimate speakers of the from speaking as many many left after listening to this charade for well over an hour or more.
When called on it during some of this illicit testimony MMS decided that they would note on all the speakers who spoke 'on behalf' of a public official that it was not the public official that spoke.
Another sham perpetrated by the Dal'liance to "Protect" the VIEW... Of a few.

Jeff,
You know I'm up for the battle, and got old scores that will need to be settled. If they don't get the cell and bars, the best we can hope for is a prison of their own making--shunned by the media, public and towns. Only to be in the company of their own twisted minds. The lunar eclipse is a sign of changing times and revelations. I've finally turned the corner with one last push. Magicians practicing the art of illusions have finally revealed themselves to the public. Now all we need are the fed's to finish what some have started. I wonder if Manso will ever get his book published? I hope it won't be another disappointing tale of Peyton Place horseshit. Although, I would like to read the goods he's got on floozie Flook. I wonder if she would still have the balls to live in Truro after that news gets out for all to read. Maybe then, Tim Arnold can sue. He will have a great case, and so everyone else, including her own publisher. Every dog has his day, she's a man in drag, got baratone, looks like a linebacker....no wonder my boss dumped her. Christa beat her even in death.

"....he stuck around Cape Cod even as the entire town of Truro was subjected to a DNA collection sweep, and found himself accused and convicted of rape and robbery and murder -- solo, all by his lonesome -- because of a DNA sample he had provided years earlier"....yes and many are let off the hook because they put the wrong man and woman behind bars. Maybe when the towns find out who really did this killing/coverup, they will turn on the real killers. Strange what money will do to people. If they know that harboring a killer will mean they don't get to collect the tourist dollar anymore, maybe that will make them turn on these cold hearted criminals. Better to be patient and get the right killer/conspirator than screw it all up a second time. And since it won't be held in the fishbowl of Barnyard Court, the big fish in their small ponds don't get the same celebrity status they seek. Boston doesn't even know they exist. Maybe the egomaniac writers can go groom their own egos in the mirror. One writer who wishes she could be a man & other acts like a woman, many looney tunes.

if not so damn tragic--this bungling DA could have a spot on Comedy Central--DNA sweep, lame attempt at fooling the public, adding insult to injury, putting it on our tab, he claimed more than a few times, "no money in our budget"....but we can spend it for a useless DNA sweep, when we know who did this crime, but he/she is one of our own, they won't go down, because they have too much dirt on us....this is so sickly transparent, who can't see this for what it truly is? How does this DA still have a job? Where is doctor shoot'em up cowgirl these days? Is she still holding hands with the DA at that cozy pub on lower cape? Someone said, "the DA is always after successful women with lots of money, including my friend"...seems he gives lessons to his rogues, is that what they teach at the academy? "Cop-Gigilo 101 and still get to collect a state pension"....nice life. Maybe the doctor will come to her senses with all that therapy she's getting and tell the media how she got seduced and swindled by the DA. I'm sure that's what happened & why hubby on crutches is dead.

DNA--was not collected until years later, first sample lost in a lab, retested, CM's probation officer forced him to provide it or else face jail time, someone mentioned it is LEGAL FOR COPS to lie.... CM never leaves the Cape all this time, cooperates with the rogues who then turn on him later while Mason types up a phoney statement that was never read, never initialed, nor signed by the defendent, someone mentioned Costa was at CM's house the day he was arrested smirking outside while Chris was handcuffed and hauled away for over six hours of badgering, disoriented by pain med's for back injury, without food, drink, bathroom breaks, no counsel, all unrecorded. Nine page statement of 6 hours of interrogation, yeah, okay, tell us another fairytale.

How about this getting investigated throughly before the lynch mobs show up for the principal, the teachers, or the alleged bully?
Sometimes (and I personally know of a case in a nearby school), a kid complains of "bullying" because some other kids tease him and won't let him play with them. That's tough, but it's happened to all of us and it's part of growing up and learning about life. And parents' and teachers' time and emotion are wasted just to find out the "bullying" was made up.
Everybody is too ready to shout the new catchwords "bullying" or "sex abuse" to gain attention or to get some one else into trouble.
If this kid is really terrifying other kids, pull him out of that school and send him to a facility for troubled children. He is too dangerous to have around.
If the principal and/or teachers are looking the other way or don't want to be bothered addressing the situation, fire their useless asses and make sure they never teach again.
But let's first get the whole truth and nothing but the truth.

There was once an Hyannis Elementary School Principle named John Linehan ... he followed us to the Barnstable Middle Schools when we matriculated. It was alot more rough and tumble then, but he had no fear of upsetting anyone's sensibilities and dealt with these circumstances with dispatch. I know ... he straighted my young _$$ out with 13 expulsions over 6 years. I still remember him w/great respect and appreciation. Where are the principles of that ilk nowadays?

How about those in authority fire the principal and then demand action by the PD? This is all very simple...one student has assaulted several others...end of discussion. the school has been told of these incidents and has decided to leave innocent victims at risk....end of discussion. Now that the whole thing is public certain folks in various agencies with clear legal responsibilities must either act or be included as accessories to these crimes....end of discussion.

Why is it that if a child brings a squirt gun to class or a girl brings a Tylenol for cramping, they are immediately expelled for 2 days. Zero tolerance policy b.s. But if a kid is provoking this much havoc on the entire student body..... the school has to "remedy" the situation before taking action?
If I was one of those parents, I'd be in the principals face and knocking on the door of the kids house.
I'm sure the argument will be that the kid has "special needs" and we have to be all-inclusive. Meanwhile, the good kids will have to live with this ugly experience the rest of their lives. It's time for our educators to get some spine.

Jeff,
In your other blog posting, you stated that the abuse was "sexual abuse". Is this the same case?

sad it is, monponsett, and right you are both. and while i believe the system is designed this way, in terms of the financial implications of this kid's expulsion, the administration still has a lot of explaining to do for the situation, and the kid's parents have a lot of explaining to do for their child, for example, is he abused at home?

The fear of lawsuits in this country is irrational and unfounded, and paralyzes common sense action.
It is possible for the parents of the bullied kids to do a civil suit against the parent(s) of the bully, but that would require that the parent(s) have some assets, which may not be the case here.
What the heck is the point of taxpayer-funded charter schools if they still have bullies? There should be an academic entrance exam which kids have to pass to get in, and zero tolerance for for bad behavior. Otherwise, what's the point?
How can you have excellence in a school if you allow the academically and socially challenged to get away with anticocial behavior?
Horace Mann doesn't necessarily need to kick this kid out, but needs to do something to address these parent's concerns, not just ignore them. That's why Horace Mann ended up on this blog.
Google yourself in a couple of days, Horace Mann, you won't like what you see.

If that's in like Hyannis Port or something, tell them that I'll send Abdullah down there to deal with the kid if they can come up with a thousand ollarsday.

I bet it's like a really stupid 14 year old, stayed back like 3 times.
Sad story, of course... but it is sort of funny to see a kid at that age mean enough that it seems as though his sole joy comes from terror.
There's probably a niche for him somewhere, most likely in either the NFL, organized crime, or the military.
Then the school empowers him, because they don't want some BS lawsuit or they don't want to pay for a SPED placement. You can be sure that the child knows he is free to continue his reign of terror.
"It takes a special sort of man to understand and enjoy liberty — and he is usually an outlaw in democratic societies."

About This Blog
Samizdat (Russian: самиздат) was the clandestine copying and distribution of government-suppressed literature or other media in Soviet-bloc countries. Copies were made a few at a time, and those who received a copy would be expected to make more copies. This was often done by handwriting or typing. (Credit; wikipedia)
