Hi, Buzz

Khalid will get as fair a trial in NYC as he would anywhere else in America, and a lot fairer than before a military tribunal. It will be a panel of 12 ordinary citizens who hear his case, as opposed to a panel of military officers.

The biggest joke in the OJ trial was not the ineptitude of Assistant D.A.s Clark and Darden, letting Furman tell Flea Bailey that he'd never in his whole life used the word "nigger," but D.A. Garcetti himself who decided to hold the trial in the 'hood instead of in Brentwood where OJ lived, where the murder was committed and where his actual peers resided.

Holder and the U.S. Attorneys in the Southern District of New York are a whole lot more competent.

Even my democrat attorney friends, who represent the DNC here in Massachusetts, never
utilize such crap in their arguments, and discussions with me.

Do you think he can get a fair trial in NY? Maybe an impartial jury that hadn't heard of the attacks of 9/11...you know, the OJ jury.

Which rules of law and procedures should be adhered to and which should be discarded to allow a fair trial for both sides?

How will we prevent national security related information, like informants, and agents, from being exposed to defense related evidence and probing?

Let's hope its a swift trial and martyrdom comes quickly.

"The case, at its core, is simple: is a crime lab report a form of testimony, so that the prosecution may not use it at trial to buttress its case unless the technician or chemist who prepared it is at the trial to defend the test results under cross-examination"?

Massachusetts Attorney General Martha Coakley had trouble from the outset drawing distinctions between eyewitness testimony for which confrontation is required and crime lab reports, as Justice David H. Souter, along with Scalia, pushed the point. She also failed to impress with a key point both in her brief and her oral argument: the Court has never had a confrontation case involving a lab report.

Before long, Justice Kennedy was stressing to Coakley the arguments he said she had to be ion making, and mildly chastised her when she did not do so".

"She responded that Calif. was one of the 35 states supporting Mass. in the case. But Chief Justice John G. Roberts, in an awkward moment, had to point out later that Calif. was not one of the 35. Pressed by Kennedy, Coakley said she had no substantive knowledge of Calif’s experience. “I don’t have enough information about the way Calif. works or doesn’t work,’’ she said.

That prompted Justice John Paul Stevens to interject, “Well, it seems to me it’s a very important point.’’
In addition, she had trouble dealing with two other justices’ questions over distinctions between crime lab reports and eyewitness testimony, and, at one point, Kennedy pounced when Coakley began to respond to a question. “That’s a nonanswer,’’ he interrupted, with clear irritation.

Lyle Denniston, a veteran Supreme Court reporter who observed the session, said Coakley fared “very poorly.’’
“She simply flubbed it,’’ said Denniston, who has reported on the court for more than 50 years for the Globe and other newspapers, and now writes for SCOTUSblog".

I don't get it either. Isn't she suppose to be running for U.S. Senate so she can represent the will of the majority of Mass. voters? Isn't that why we have "secret ballots", as one voter quickly pointed out? But after you vote, they all know who you voted for from their lists, don't they? Some of these comments about the AG are just TOO TELLING...she sides with Alabama on the death penalty? Yes, I'd say this is progress especially when they sentence a person suffering from severe mental impairments to death.
