Ruminate on the following for a minute:
it is my belief that posting anything on the internet that has the potential for child endangerment is a felony. Someone might want to check MA and federal laws. Did you run this by the legal department before you ran with it?
Someone needs to take you out behind the woodshed for a good dose of capemom's reality and truth. Wish I were available, I would gladly dust the seat of your pants with an old-fashioned paddle.

If you want to talk about McCowen and guilty vs. not guilty, there are several places that would welcome your posts.

Did it ever occur to you that simply by mentioning the possibility of the use of regression hypnotism that you may have endangered Ava? Regardless of whether it could be done or whether the results could ever be used in court, this was a totally irresponsible subject to broach in a public forum. Of course, this is my opinion, obviously you have your own.

It is a rare court, I hope, that allows hypnosis testimony to play a role in a trial. There have been many instances in which regression hypnosis has caused children to give false accounts of events when they were young. There are men currently incarcerated and a few released that were there that were convicted based on the sole testimony of the child corroborated by the therapist.
You really ought to do better research sir before you spout such outlandish notions as viable options.

Those TROs were discussed at great length by media outlets covering the case. One specific TRO caught my attention. If I fail to recall every detail, I apologize. A young girl ran away from home. Went to see McCowen. Spent the night there. He convinced her to go back home. The mother was so outraged that she brought allegations to the police. Anyone remember more details?

By all means, let us get the domestic violence/restraining orders introduced on the condition that all of the complainants and police officers and social workers and witnesses be required to testify as to their personal knowledge and involvement in how and why those restraining orders came into existence. I think that is a grand idea. Wonder how many more would take flight?

Maybe someone should more closely examine the DAs alleged TOD and how it doesn't quite fit the original ME's report. And then someone can talk to the original ME about what precisely afflicted him such that he was unable to testify at the trial. And someone could find out why naming late Friday night/early Saturday morning was paramount in the prosecution's case.

Is this like saying that maybe the "conspiracy theorists" could be right? Isn't that the essence of this motion? That all of them knew certain things and deliberately suppressed it/them?
According to the boston.com article by Denise Lavoie, O'Keefe was quoted as saying that BG could have gotten the evidence of JF's criminal history from the Probation Department. I was under the impression that Probation maintained records of CONVICTED people. I didn't realize that they could/would maintain records on people whose charges had been dropped. Is this an example of another inane comment?

if you can locate a copy of the security video of cw and ava in the grocery store on friday you can see that she was disheveled to say the least
did not appear to have recently showered
and the mccowen dna found on cw's breast was mixed with ava's saliva
don't even ask me to speculate on how that could happen
maybe it would be more productive to concentrate on the things that were missing from the murder scene
for example, whether the sex was consensual or rape, mccowen's hair and prints should have been in that house
not a single hair and not a single print that belonged to him
let me see, you think he was smart enough to sanitize the scene and yet dumb enough to leave his semen
right!

you compound this with a view of your moral fiber, slightly warped in my opinion
so let's reverse the situation and determine if your answer would be the same or different
IF it were your brother or cousin or husband or lover incarcerated in a facility that is criticized as one of the worst in the MA DOC, and if YOU thought he were wrongly incarcerated, would it still be ok for the guards to harass and beat and torture him since he would then be a convicted felon? would he cease to be a human being at the time of incarceration?

i don't have time to do a lengthy research project at the moment, but thanks for the info
makes me wonder what is happening statewide in those regards
more concerned with where bittersweet found what she posted
and even more interested in finding out if susan (or you, if you care to respond) thinks that it is ok to harass, beat and torture prisoners if they are convicted felons
what about if it is just someone that has been arrested and awaiting trial, is it still ok to harm these people?

at the risk of mixing metaphors, which no one else seems concerned about, the last time i saw this much sidestepping, it was done to music and they called it dancing
even my 5 year old can answer simple questions
since you appear to be more than a little reluctant to answer my other question, try this one, you said: "The funniest part is seeing wide-eyed reporters, journalist, lawyers, ADA's and asssistants sitting up like trained dogs waiting for their next command because they think it's a real case."
are you insinuating that mccowen is in prison and there was no real case?
i personally believe it was one of the weakest circumstantial cases i have ever watched, with one exception, but the prosecution did have a real case, flimsy though it was... in my opinion

thanks for pinpointing one of the most disguised inconsistencies in this case, the TOD
flew right past the jury
most posters missed it
for those that commented on it, most referred to it as smoke and mirrors by the defense
few realized that the original ME was medically indisposed and that a substitute testified based on the original MEs notes
lots of accidents/incidents in this case...leaves one wondering what in the world was happening on the cape

give me a break... pay no attention to my nic... it was derived in a most round about way and in no way reflects on my method of income... get over it and answer the question... in your mind, what is worse than murder?

let me tell you what i think...murder is a most horrendous act perpetrated on an individual from which there is no recovery for the victim
in addition, society simply tries to even the score, in a lopsided way, by convicting the perp and locking him/her or them away so that they cannot continue in said behaviors
this is done as much to protect other individuals from such heinous acts in the future as to punish the perp for the act already proved
please note that this is my opinion and is not the result of legal training, but rather the university of life and learning

The only failure-to-report statute appears to refer to failing to report the purchase of a firearm from an unlicensed seller (see Mass. G.L. c. 140, § 128B) rather than the failure-to-report a firearm larceny.
Q:3)what are the laws in MA regarding the destruction of known weapons that were involved in crimes? held in evidence in post-trial criminal cases?
A:Tampering with a serial number or being in possession of a firearm with a defaced serial number appears to be a violation of Mass. G.L. c. 269, § 11C, removing, defacing, etc., serial or identification number of firearm. I don’t find any “special waiver” for law enforcement officers. According to Mass. G.L. c. 276, § 3, after such confiscated weapons are no longer needed for court proceedings, they are delivered to the colonel of the State Police, who determines whether to sell or destroy them. Since all firearms sold in the Commonwealth, with the possible exception of antique or so-called “primitive” weapons, are required to have serials number (see Mass. G.L. c. 276, § 11E),...(continued)

in an effort to utilize an independent source, i sent a querry off to MA Law Library...you send a question/s and a research librarian provides answers.
Q:I am interested in handgun laws in MA as they relate to the following:
1)reporting or not reporting a stolen gun to law enforcement...is the failure to report a gun theft a felony?
2)possession of a handgun that no longer has a serial number...is it possible to register this handgun without a serial number? is there a special waiver for handguns of this type? is there a special waiver if the handgun is in the possession of a law enforcement agent?
A:If it’s not your handgun that’s been stolen, the law doesn’t appear to impose a positive duty upon the citizen to report a crime. However, if it is your handgun, you are required to maintain custody and control and several criminal statutes may apply if you lose custody and control, such as Mass. G.L. c. 140, § 131L, improper storage of a firearm, and § 131A, permitting the improper use of a firearm. (continued in next post)
