In response to: McCowen’s Bid for Retrial Gets Major Boost
If a mistrial is declared, would there still be a hearing on the exculpatory evidence motion?
In response to: Manso-so

while snippets and some paraphrasing of the motion have appeared several places, it is refreshing to be able to read the motion in its entirety
In response to: Hypnotizing a potential witness - Worthington's daughter
Someone needs to be!
BFN Jack, will see what next you decide to post. I must admit, you have an uncanny knack for posting controversial material.
And goodbye also to capemom (aka:Mrs. Ostrich), one of these days you may get your head out of the sand...or the sand out of your head.
In response to: Hypnotizing a potential witness - Worthington's daughter
Thought you had more credibility than a lot of other bloggers, but I was disappointed.
Nice to see you were still in the building though.
In response to: Hypnotizing a potential witness - Worthington's daughter
Ruminate on the following for a minute:
it is my belief that posting anything on the internet that has the potential for child endangerment is a felony. Someone might want to check MA and federal laws. Did you run this by the legal department before you ran with it?
Someone needs to take you out behind the woodshed for a good dose of capemom's reality and truth. Wish I were available, I would gladly dust the seat of your pants with an old-fashioned paddle.
In response to: Hypnotizing a potential witness - Worthington's daughter
You haven't had a dose of reality in so long you can't even spell it, much less understand it. And truth? God help you if truth ever visits you in your world, it would scare you to death.
Scream conspiracy somewhere else.
This is supposed to be about Ava and regression hypnosis.
Are you helping Jack out by trying to steer the topic in another direction?
If you want to talk about McCowen and guilty vs. not guilty, there are several places that would welcome your posts.
In the meantime, Jack needs to pull this now! And stop hiding behind someone else's coattails. That is too childish.
In response to: Hypnotizing a potential witness - Worthington's daughter
Most likely, the man who killed Christa was a man who had a long-demonstrated history of violence against women, a pathological sex drive, access to and knowledge of Christa's house, was using drugs at the time of the killing, and a desire not to have his victim call the police on him. Hence the stabbing.
Where in the hell do you get your information? Is it direct from police records? The DAs office? Or from your own mind?
Write a book. It could be a bestseller. Make it fiction. You are a great storyteller. Stay away from real events though. You might be sued.

You really ought to do better research sir before you spout such outlandish notions as viable options.

I hope you get counselling somewhere and soon. Your venomous anger is dangerous to your health. Maybe a punching bag is a viable option, but bashing here is neither acceptable nor productive.
In response to: McCowen wants new trial - claims real murderer was Frazier
According to the boston.com article by Denise Lavoie, O'Keefe was quoted as saying that BG could have gotten the evidence of JF's criminal history from the Probation Department. I was under the impression that Probation maintained records of CONVICTED people. I didn't realize that they could/would maintain records on people whose charges had been dropped. Is this an example of another inane comment?
In response to: Reasonable doubt about a verdict
(this was from an interim report generated on April 13, 2005)
listen for yourself:
http://www.courttv.com/video/player.html?videoSrc=#highlights
click on Trials on Demand
scroll to end
lots of excerpts there
anyone remember hearing this is the trial?
"At the very end, the court heard that a human blood stain on Worthington's shoe is still unidentified, but that it's definitely not McCowen's."
this quote can be found here:
http://www.wgbh.org/cainan/article?item_id=3097878
this is from friday, 10/27/06
so who bled on CWs shoe?
In response to: Reasonable doubt about a verdict
are you all gullible enough to believe whatever you hear from those in authority?
did no one teach you to think for yourselves?
you make me tired, i'm calling it a night
In response to: Reasonable doubt about a verdict
did not appear to have recently showered
and the mccowen dna found on cw's breast was mixed with ava's saliva
don't even ask me to speculate on how that could happen
maybe it would be more productive to concentrate on the things that were missing from the murder scene
for example, whether the sex was consensual or rape, mccowen's hair and prints should have been in that house
not a single hair and not a single print that belonged to him
let me see, you think he was smart enough to sanitize the scene and yet dumb enough to leave his semen
right!
In response to: Reasonable doubt about a verdict
but your baying at the moon is most bothersome
do you even read what you write?
you said, "McGowen had fooled her with his 'I'm a nice guy' routine; she trusted him. She opened the door, and was ambushed by them. She fought back."
how could mccowen kick in an open door?
wasn't that what the pros case was?
yep, breaking and entering
so where is the breaking if she let him in?
and who did the boot print on the door belong to?
would that be TA who admitted to LE that he had tried to break the door down
you can find that in mason's testimony on cross
so there was no breaking and no burglary
they had sex and you convicted him of murder
is your conscious driving you nuts? if it isn't it ought to be
In response to: Reasonable doubt about a verdict
i enjoy being devil's advocate
just can't take the other side in this instance
i agree wholeheartedly
you voiced my own opinion so well about this case
never have i seen it summed up quite so succinctly
i could elaborate on each of your points for pages and pages, but won't
In response to: Reasonable doubt about a verdict
just thought you had quoted from a specific source
In response to: Reasonable doubt about a verdict
thank you for responding
you immediately assume things you know nothing about and voice them
you compound this with a view of your moral fiber, slightly warped in my opinion
so let's reverse the situation and determine if your answer would be the same or different
IF it were your brother or cousin or husband or lover incarcerated in a facility that is criticized as one of the worst in the MA DOC, and if YOU thought he were wrongly incarcerated, would it still be ok for the guards to harass and beat and torture him since he would then be a convicted felon? would he cease to be a human being at the time of incarceration?
In response to: Reasonable doubt about a verdict
makes me wonder what is happening statewide in those regards
more concerned with where bittersweet found what she posted
and even more interested in finding out if susan (or you, if you care to respond) thinks that it is ok to harass, beat and torture prisoners if they are convicted felons
what about if it is just someone that has been arrested and awaiting trial, is it still ok to harm these people?
In response to: Reasonable doubt about a verdict
i understand the knee jerk reaction
as for punishment being the primary cause for executions, i prefer life and lots of time for regrets, if not remorse
In response to: Reasonable doubt about a verdict
is your statement implying that you think harassment and beatings and torture are okay if the victim is a convicted felon?
In response to: Reasonable doubt about a verdict
where did i hear that her tub was full of toys? was that in court or in the rumor mill?
In response to: Cape Cod of yesterday--In the words of a local
interesting? interesting?
well it is a response, but it definitely falls far short of an answer
keep your opinions to yourself... you are most likely the only one that can decipher them anyway...i suspect the rest of us are just too ignorant to be educated... yeah, that is probably it
have a nice life...too difficult to maintain a conversation with self, so i shall cease this meaningless inquiry
In response to: Cape Cod of yesterday--In the words of a local
at the risk of mixing metaphors, which no one else seems concerned about, the last time i saw this much sidestepping, it was done to music and they called it dancing
even my 5 year old can answer simple questions
since you appear to be more than a little reluctant to answer my other question, try this one, you said: "The funniest part is seeing wide-eyed reporters, journalist, lawyers, ADA's and asssistants sitting up like trained dogs waiting for their next command because they think it's a real case."
are you insinuating that mccowen is in prison and there was no real case?
i personally believe it was one of the weakest circumstantial cases i have ever watched, with one exception, but the prosecution did have a real case, flimsy though it was... in my opinion
In response to: Cape Cod of yesterday--In the words of a local
In response to: Reasonable doubt about a verdict
thanks for pinpointing one of the most disguised inconsistencies in this case, the TOD
flew right past the jury
most posters missed it
for those that commented on it, most referred to it as smoke and mirrors by the defense
few realized that the original ME was medically indisposed and that a substitute testified based on the original MEs notes
lots of accidents/incidents in this case...leaves one wondering what in the world was happening on the cape
In response to: Cape Cod of yesterday--In the words of a local
does someone else do the thinking and you do the spouting?
In response to: Cape Cod of yesterday--In the words of a local
let me tell you what i think...murder is a most horrendous act perpetrated on an individual from which there is no recovery for the victim
in addition, society simply tries to even the score, in a lopsided way, by convicting the perp and locking him/her or them away so that they cannot continue in said behaviors
this is done as much to protect other individuals from such heinous acts in the future as to punish the perp for the act already proved
please note that this is my opinion and is not the result of legal training, but rather the university of life and learning
In response to: Cape Cod of yesterday--In the words of a local
btw...i didn't say that i disagree about a coverup or a wrongful conviction...
In response to: Cape Cod of yesterday--In the words of a local
then try this: you said: "Everyone involved is just covering up a really big crime, that actually had nothing to do with murder and a lot more to do with money - it seems."
my questions seemed to be clear, so i will repeat them..."what crime is bigger than murder? multiple murders?"
sorry...i don't know how to be more concise...and they seem to be specific... sooooo?
In response to: Cape Cod of yesterday--In the words of a local
In response to: 1894: How the Kennedy dynasty began in Congress
The verdict may be vacated as a result of the racial bias hearing and then the appeal would be moot.
Imagine that!
In response to: WWMD - What Would Murdoch Do?
archaeology can be a very interesting topic of study
In response to: WWMD - What Would Murdoch Do?
it seems unlikely that the State Police would allow unidentifiable weapons back into general circulation by selling weapons with defaced serial numbers.
end of quote
Not everything one would want to hear, but informational nevertheless.
In response to: WWMD - What Would Murdoch Do?
Q:3)what are the laws in MA regarding the destruction of known weapons that were involved in crimes? held in evidence in post-trial criminal cases?
A:Tampering with a serial number or being in possession of a firearm with a defaced serial number appears to be a violation of Mass. G.L. c. 269, § 11C, removing, defacing, etc., serial or identification number of firearm. I don’t find any “special waiver” for law enforcement officers. According to Mass. G.L. c. 276, § 3, after such confiscated weapons are no longer needed for court proceedings, they are delivered to the colonel of the State Police, who determines whether to sell or destroy them. Since all firearms sold in the Commonwealth, with the possible exception of antique or so-called “primitive” weapons, are required to have serials number (see Mass. G.L. c. 276, § 11E),...(continued)
In response to: WWMD - What Would Murdoch Do?
Q:I am interested in handgun laws in MA as they relate to the following:
1)reporting or not reporting a stolen gun to law enforcement...is the failure to report a gun theft a felony?
2)possession of a handgun that no longer has a serial number...is it possible to register this handgun without a serial number? is there a special waiver for handguns of this type? is there a special waiver if the handgun is in the possession of a law enforcement agent?
A:If it’s not your handgun that’s been stolen, the law doesn’t appear to impose a positive duty upon the citizen to report a crime. However, if it is your handgun, you are required to maintain custody and control and several criminal statutes may apply if you lose custody and control, such as Mass. G.L. c. 140, § 131L, improper storage of a firearm, and § 131A, permitting the improper use of a firearm. (continued in next post)
In response to: WWMD - What Would Murdoch Do?
i can see RICO in this
would take the state out of play and insert feds...hopefully?
In response to: WWMD - What Would Murdoch Do?
anyone check to see if the stolen items may have winged their way to naples?
with a mortgage that exceeds 600K, is this man independently wealthy?
is there a mortgage in naples?
maybe his stint as DA is simply for public service and he refused his salary?
yeah....right!
In response to: WWMD - What Would Murdoch Do?
is it possible that there are 2 persons with the same name? 1 resides on the cape...another in naples? could it be the same person?
use anywho.com and insert name... you will see requested address and phone of ???
a mortgage on the cape...is there another in naples?
In response to: WWMD - What Would Murdoch Do?
as a first time poster, i say thank you for sqawking loudly enough that mainstream media finally got the message...
IF there is fire in all the smoke, then keep on digging...you will find the coals if not an actual blaze...
for those that are interested in the legal consequences for improperly held or registered handguns, i submit the following... go to
http://www.mass.gov/Eeops/docs/chsb/cori_master_crime_list.pdf
you may find other handgun violations within the federal laws
if the hole gets deep enough for the nonresponsive DA, will it fall in on him?
