".....despite its own involvement in its dismissal, the identity of the judge who dismissed it, the eerily similar details of that crime...... "

Does he mean judge Nickerson dismissed that other case?

yes, I hope someone can put those emails in the paper so we can all read them. Very chummy - and I agree, the jurors were looking for $$$$$.

The Boston Globe describes the game differently. They said the person was acting out the phrase "beaten by a big black man"........

I disagree - if the trial is about a black man and there is only one black juror - and the rest of the jury singles out that juror for ridicule = that not only shows racism, but intimidation, which can't be good for deliberations.

Jeff,

was wondering, how many of the jurors spoke about the charade game? Only the two left out?

One criticism, though - the idea that McCowen claims that JFrazier killed Christa Worthington came from the "confession" - which many believe was false and coerced. I don't think he or his defense claim to know who killed Christa. Don't let the police put words in his mouth.

Very nicely written.

Unbelievable events.

they really played this game? This was actual testimony??

not only IN HIS HOUSE - but sticking out of his closet?? Ha Ha! that's how they got the "search warrant". What were they searching for, I wonder.

Crusader,

In your zest for tearing down the DA, I believe you are being a traitor to your own gender. All that I have read spells ABUSE in this case. The case went before a Grand Jury and they did not indict.

" She told her coworkers and friends that her black eyes and other facial injuries were the result of playing basketball with her sons." (Boston Globe)

I have to assume that there were witnesses to this and this is what the Grand Jury responded to.

When you talk about her "health" - you mean her depression and suicide attempt?? And you don't think that was a result of being trapped in an abusive "good catholic" marriage?? Are you saying that this "health" problem is proof that she was unstable - and the fact that she first tried to take her own life should be used against her?

I found the brother-in-law's interview to be pathetic and incredibly transparent. I can't believe hyannis.com would lap it up like that without question.

WEll, duh!
Shows a certain attitude - like, it was HIS abortion, HIS body, etc. Maybe it is a family issue. Have a hard time with somebody defending M. Vick for one thing. That guy was not just betting on dog fights - he was executing dogs who weren't aggressive enough. Some comparison to use! Perhaps very telling.

Same with the interview with the brother-in-law. The guy is divorced so he obviously has this deep resentment of the Gryboski women. If he could have contained that obvious resentment and hatred, I might have believed him more.

"By the way ....that perfect catholic family (her parents) while she was in med school she got pregnant and her parents called and asked if our parents would talk Pat into getting an abortion for they wanted a Dr in the family soooo bad .
This stunned us to no end. and then to read in the Boston globe of how wonderful the Doctor's family ."

How is Pat going to get an abortion? Isn't that a man we are talking about?

from CapeCodTimes 2002 article:

"Asked about his prosecution style, he said: "You've got a limited amount of resources to bring to bear on this process of criminal justice," said O'Keefe, who said most crimes either fall into the category of "human frailty" or "genuine evil."

"Use a little compassion when it's human frailty. Use the heavy foot of the District Attorney's Office when it's genuine evil."

...so, I guess he figures he gets to decide.

First of all, I'd find the babysitter and make sure that quote is accurate. I've always had my doubts about that.

Having raised a 2 yr. old, it is not necessarily true that they wake up easily. sometimes they do and then sometimes they sleep through anything.

It is also my opinion that Ava might have been watching TV when this happened - most of it happened outside and what happened inside was so fast that Ava did not see. The time-of-death estimate puts this murder during the daytime. Probably in the morning (saturday).

As far as the shower/no shower. The internal DNA could/would still be there + the lab showed that it was the minor contributor to the sample (CW being the major) and it was "degraded" (meaning "old") - so, that is in line with it being from Thursday. As far as the DNA on her breasts - that was such a small amount (and it was NOT saliva) that it could have been tracked in by Ava from the living room (the room he claims to have been in on Thursday) - We know Ava spent some time that weekend in the living room because there was a tape pushed in and the TV on, bloody finger prints around & since she was nursing, it would end up on the victim's breast. Transfer DNA, very possible, I think.
