Good Luck Christy, I know you will prevail. With two Trustees, one of them the Treasurer for Homestead Condominum Trust, the other a recorded trustee (Registry of Deeds 03/06/2001) I wonder how many of the other members are in favor of this, in my opinion, waste of time and money. Maybe a full service station would be better off with the compressors and air guns and all the noice and smells associated with it would be better. Check out the 1/3 owners signing on as well. Kevin should control Mary and Shirley Carol has better things to do, in my opinion.

Good Luck ! I knew you would prevail ! The appeals will in my opinion die a horrible death as they carry no weight, only personal opinions and feelings. Courts really do not care on those issues, however, do create an additional expense. If those that oppose are smart, it will all end here. Good Luck and look forward to it opening before summer!

When I write an article, I rarely comment, unless it deserves one. I get upset when people comment without making proper obervations and accurate accountings. The paint job, if you care to pay attention was an wonderful faux earth tone painting, the bar had been moved to a new more inviting location, the tables had been reduced, a wall added for an office and the sitting tables in the main area were situated so everyone eating ahd a view of whatever was going on. You picked an appropriate name windbag! I haven't tried the pizza at the establishments you mentioned, stand by I will. By the way where are they?

Agreed. My intent was not to place the blame or burden on anyone. Although the town of Barnstable, to it's credit, returned an email and agreed to look into the situation and enforce appropriate laws. The parties that abandoned the garbage are the ones that are on the hook. The garbage isn't the problem. The fact that it remains is. No one is pointing fingers nor was the article intended to. Silly statement or not,it is not the neighbors obligation to clean up the mess, the property owner owns the problem. When problems are ignored, does it then become the neighbors obligation to resolve it. I think not, it was brought to the attention of the authority that could resolve it, and I am confident in my town that they will. Thats what our gov't does. With a 5 million dollar shortfall in the school budget, they have other priorities, as I do. We have an obligation to bring it to someones attention, no differant than a barking dog complaint keeping you awake all night, the authorities have better things to do, but it is taken care of, which one is more problematic? The dog or the garbage ?

Good Question. I talked to the Demo Company this AM. They would not comment on the stop or delay but said they were heading back to the location today to finish the demo. No calls were returned from Barnstable Town Hall today regarding the project.

You raise a very good question. Apples to Apples, agreed. Of the $14,185.00 raised since announcing, $5750.00 was contributed from outside of Barnstable County $8435.00 from within Barnstable County.

karent2- Your points are well taken. 6 months of bills represented 130 pages. FOIA was filed, with a rather staggering amount requested for the copies. Truro, depending on which source you use, shows a total land area of 21.06 Sq. miles. Approx 70% of the land area with the Seashore. Again, depending of the source, between 1800 and 2100 year round residents. FY 2008 legal budget appropriattion was $107,500.00 . They expended what appears to be $119,925.99 according to the documents obtained on 10/16/08. Perhaps a comparison to a town without Seashore property within its borders may be in order. Larger towns with more services, departments,schools and population should have a larger legal budget, I would assume, but lets find out.

Good Questions all. I do not have the answers. When I proposed similar qustions to a fellow gun owner, much smarter than I,he responded "Welcome to
"Welcome to the east coast land of the fruits and nuts." Whatever that meant, I accecpted it. The flaw in the law really has to be addressed. Ignorance of the law is no excuse. I know several people in a position similar to those described and I am doing my best to make them aware. Troubling to me are the people in a postion that are not interested in qualifying by getting proper training to qualify for an FID card or pistol permit to cover them for the constructive possession or handed down or inherited weapons, some I might add that if the owner was properly licensed are very valuable and would put much needed cash in their pockets to help pay their heating bills this winter. Programs of amnesty to turn them in have happened in some areas. How about a program to grandfather these people for licenses so they may properly sell them and help out i these difficult economic times. I'd love to help in authoring a program like that. Just me.

Fender when roped or tethered are short in length. Not like they can tangle someone. Eve in making asharp turn there is not enough rape to be a "prop catcher." Not even considering the sobriety of any on board if a sharp turn resulted in a run-over of the victim he would have to have been mid-ship, In my opinion. I have not seen any photos of the boat of the position of the fenders. You have to consider, reagrdless of his position on the vessel, the amount of time and the speed of the vessel when considering impact or potenttial contact with the props. "Air Time" if you will. and FPS (Feet Per Second) depending on speed could potentially put the victim numerous feet from the stern of the vessel. FYI Boat fenders, if tethered, are on short lines. I have been a licensed captain for several years. You are always aware of your party, their condition and what they are doing. If fenders hang over the vessel to prevent damage from other vessels or the dock, they are always removed once under way. In order to be cut by the props of a vessel you would have to be forward of them, or the captain would have to be backing the vessel and you fell off the stern. Falling off a vessel under way, if from the stern would put you past the danger of prop wash or damage by the time you hit the water. Falling off the bow or midship would highly unlikely put you in the danger of being pulled into the wash of the props unless you were at the bow of the vessel and were forced under due to the speed and design of the boat. Like being run over, then you could be injured. Autopsy results will be important (Blood Alcohol Level) , Its to late to determine anyone elses BAL. Regardless, its a tragic accident, but one that someone should be responsible for. My heart goes out to the family. God Bless.

As the Commonwealth's repository for firearms records, the Firearms Record Bureau (FRB) maintains a database of licenses issued including licenses to carry firearms (LTCs), Firearms Identification (FID) cards, gun dealer licenses, and machine gun licenses. The FRB also keeps records of firearms sales by gun dealers, as well as private transfers of weapons. As a result, law enforcement agencies have access to data on over 280,000 FID and LTC records and over 2 million gun transactions as an investigative tool.

In addition to processing about 4,000 records per week, the FRB is a valuable resource for the public and law enforcement agencies to answer questions regarding the Commonwealth's gun laws.

FYI - A story was submitted. The Manso part of the story was going to be part two. It was posted and there are those of you that seem to think there is some type of conspiracy. There isn't. Call it what you want but please stay on the topic. I have not been censored, I asked that the second part of the story be deleted until such time I completed it. There has been much that has surfaced since the writing of the original article and it requires further investigation. No fault of the editors, no fault of myself. I know its a phrase that is used to often, but I do try to be fair and balanced, Admittedly, I have never met the Parlante's but would welcome the opportunity as I have some other questions that perhaps Michael would only be able to answer. I would welcome that opportunity, and would be happy to report what they have to say. My email is availble through the site, There are two sides to every story, I report what is reported to me and this one is pretty obvious. If you can arrange a meeting with them, I would be happy to attend. They would have to be prepared to answer some pointed questions and I am willing to answer any they may have of me. I have met with others I have written about, but to be honest, am very surprised I have not been contacted by now. See what you or someone else can do, that would even include clamshelli.

The Town has pretty broad powers with respect to actions it can take. As far as the legal process the jurisdiction for this is summarized in MGL Chapter 40 Section 21D. You can Google that section of the MGL.

The previous ability to keep a record of water usage was not as accurate as the town supply from what I understand. Tieing in to town water may have addressed the quality issue based on the failing septic but may have been a double edged sword for the Bookstore. Now there is an accuarte accounting of usage. The usage far exceeds the formula based on 95 seats hence the failing system. I feel the town will not allow any more violations as the water commissioners appear to be very serious. Everyone worked with the Bookstore to help them, I think they feel a little betrayed.

Your rights and the Blasch's rights are something that should be treasured and protected. They exercised their rights, the same ones that are afforded to us all. Agree or not that's a personal issue. There have been to many personal feelings relating to this issue. I agree with many of you as it related to personal preferences. That was never the issue. If the by-law needs to be changed, then change it. You can't step on anyones rights in the process. The rules and laws that were in place at the time were followed to the letter of the law. That should be the only issue. The Billboard house was ugly as many have said and I agree. If you want change, now is the time. Be careful that the needs of the few do not out weigh the needs of the many in the process. I'm sure there are others in the seashore with growing families that may not have the financial resources of some, and may want to add on or enlarge or tear down to accomodate a growing family. Be careful what you wish for! It may have an impact on others whether within the seashore or on a regular building lot in town. Good Luck !

I understand your frustration. The comment block isn't big enough to explain the entire process. The real question is why no-one objected during the entire process. It was all public prior to the issuing of the "by-right" permit. Having said that, one has to determine if the National Seashore is an aggrieved party. If so they can exercise powers granted to them and pay fair market value for the property. In choosing not to do so, cause there is no money available presently through the Department of the Interior, they are left with the alternative. Use in house resources, George Price and Seashore Counsel, apply political pressure, and try to slow or stop the process until the by-law can be changed. It was the same process available when the Billboard house was put up in the 1980's. But if you interested, it is all public information and available through a request to the proper department within the Town of Wellfleet. I fear the process is not a closed issue at this point. All of the aforementioned is my opinion. Wellfleet will continue to pay the bill.

I'm taking this off the top of my head, I believe the plans were submitted to DEP for review. If memory serves me right they were submitted on May 14. DEP has 60 days to respond, either to approve or not. If they do not respond it is my undestanding the project has to go forward. Saying that, if my memory is correct, that still give them until July 14th to begin work. At which time the Bookstore will have to operate a tight system requiring pumping probably daily. During this period the Bookstore is pursuing tieing into town water, which if allowed, may change the system design again. I have been assured that town water issue will not be cause for any further delays. We'll see!

Thanks for you thoughts, retirement information on individuals is protected and often times difficult to get because of information attached to the files. There is information surfacing and I am waiting for another possible source that may have very important documentation. I would ask that anyone that has info to contact me, I can protect sources. There is someone out there that is looking at "The Old Colonial Hall" painting by Whorf as well as others. They will surface whether they are in the southern part of the US, in the mid west or right here in Barnstable County. People are paying attention, reports of what people have seen in homes are coming, but documentation is needed. It will happen, I only wish a reward or an official investigation would be initiated. We can't go from "Nothing is missing" to Oh what a mystery. I really have no I'll feelings for any one individual, I have ill feelings for the process,denials and lack of actions. There are people, they know who they are, who could bring this to a rewarding end. I only wish they would step up to the plate!

Peter M - Somehow I knew you would pick up on the civil rights issue. Not to mention some commuincation issues outside a public forum. It is my understanding a civil rights attorney was present for the hearing. I have not been able to interview the attorney at the time of the posting. I'm sure there will be more to come. Thanks!

I agree wellfleetfish. The fact is the project met all the requirements of the existing Wellfleet by-laws. Set back, and size. It actually came is under the 5% rule. What is of concern to me is the building inspector did his job and issued a permit properly within the exisiting laws. My caution to the town is trying to circumvent by-laws in existance, approved by the state. (AG' Office) Internal communications, not public that is, attempting to find a way to circumvent laws in place is problematic. Is there a particular person claiming to represent the many, that has a personal interest (within the Seashore) that does not want a future sale of an abutting piece of property, expanded? Names are not inportant right now, they may be later.
I am all in favor of certain controls, having lived is an historical district for many years. Having said that, everyone has the right to work within the law. Whether anyone likes the proposal or not. If it meets the test of the standards in place, so be it. None of us may like it, but its those rights we all have an obligation to protect.

Greetings All
Every once-in-a-while I get around to reading the comments. I jsut want to say this, I report what I'm told, I admit I don't report everything I'm told or find. Please keep this in mind. There are many other stories out there that relate to the subjects being discussed. They, at this point, would serve no other purpose other than to expose some goings on that shouldn't be. I for one am happy the town recongized the flaw in the existing by-law. I am additionally happy that the Parlantes are rectifying a problem that can only be good for them and everyone else in the town. Thats not what this article was about! Providing everything is in compliance, thats is history now. Issues that should be of real concern to concerned Wellfleet citizens related to open meeting laws, and communications outisde of a public forum to circumvent Massachusetts General Laws. This is an issue I will keep track of, and it has nothing to do with the Capt Higgins or the Bookstore. Watch as I report of progress whether positive or negative. All positive I sincerely hope. To coin a phrase, I try to be as fair and balanced as I can. I only report what is reported to me. I'm sure there will be comments that will go off the subject, and thats OK too. It is my understanding that there are some known drop off point that some people are leaving items. The shoes and its location may me one. That area has been known to have camps in the past. It was explained to me that some of the homeless have other issues, and do not want to come in to any shelter, they prefer to be alone and outside. A Homeless nam Vet recently was approached with offers of medical assistance. He aldo refused to come in and remains in his secluded tree house. If anyone feels they can not afford a cash donation, feel free to drop off any clothing or shoes or blankets at the Salvation Army, they are working with the Council on the homeless issue. I did however just have breakfast with the photographers of both sets. Both very credible people and it is what it is. One had conversation with the person doing the pumping as TK was riding back to the dock paraleling the slick. Walter, sorry your liberal friends can't see the forest thru the trees, or the bottom thru the oil slick in this case.

Do you want to know the truth or not? Mav, no one was humbled by JFK more than me. I was in his house, sat in his rocking chair that was in the White House, skated with Jackie O at the rink in Hyannis at the dedication. As far as the rest, read the article and consider what is represents! Don't look at the photos if that floats your boat, but consider what is being said! CCT is unbiased as far as I can determine. Everyone has an opportunity to respond unlike newsprint and that is good. As far as being old photos, well consider this. People are just now finding a venue to express themselves where they couldn't before. Imagine going to the Times with a story such as this! It would never see print, now ask youself why? Do I have anger towards TK? Yes, and it will be seen here in the future. No one is perfect, me very much included,but we all have to be accountible for our accomplishments and failures. I can still hear the sounds of those choppers getting ready to land, as I can hear the shot from the bookstore. But I also rememeber noone should be exempt from the rules of law.

I know what you are saying. Understand I only submit what is sent to me. I am a licensed captain as well. When the original photos are submitted, if they are reversed by whom ever is editing them it changes the entire perspective. The oil path in the originals were all heading north, same direction as the prevailing southwest winds. Editors are not mariners, of that I have no control. I thank you for being that observant, it helps me with future comments to the editors when submitting photographs for publication.

Being familiar with this particular mooring field, and the no wake zone, I can tell you that the Le Grande Fromage is within 20' of some one the moored vessels. The hull speed of a formula of this size requires a hull speed of approx. 16 knots to plane. The speed of this vessels far exceeds that. I could care less if it is enforced, which it is not, read the article. Its about what the title reads nothing else! Some people are above the law, some have no respect for it. You decide, it has nothing to do with wind farms, shame on you for even thinking that. I have anchored there on many occasions and witnessed many such actions.

I too enjoyed a great day and evening with family, which included some Wellfleet seafood! I have heard nothing but nice things about Caroline Parlante. As a friend you should come to her defense, for that I respect you. I don't have a horse in this race! I report what people tell me or from documents I have in my hands. I issue no threats, I get a few , but I wouldn't stoop to that level. You confuse other peoples comments with my writing. I am sensitive to enviornmental issues, whether its my neighbor or elsewhere. Understand, If there was an issue that involved you and I had the information that would support your side, I'd be right there! No vendettas here, you have to know someone to initiate that process. I really don't want to visit the issue about cutting Caroline some slack. No good can come for anyone from that. It will play out as it will, but you & I both know the issue has to be resolved. Iwish all parties the best, and will continue to report on it as needed. Good Night!

One last Comment, before the next story!

A scorpion comes to a river and has to cross it. He see's a turtle. He asks the turtle for a ride across the river. The turtle expresses concerns about being stung by the scorpion. The scorpion explained, "I have to get to the other side." The turtle agrees and the scorpion climbs on the turtles back for the ride. When approaching the bank of the opposite side the scorpion jumps off the turtles back and stings the turtle with a deadly injection. Please understand, I report only what I am told or I have documents to back up. Please keep slamming me if that makes you happy, it does me also! I just got back from looking into other issues realting to this and decided to read some comments, honestly, I do not do that very often but its fun sometimes.
I went back to the first article,and re-read it. Please point out to me where there are errors. Mr. Parlante is the treasurer of the Bookstore, he is an officer in the Central Wharf Associates, (which incidently the rest of the Corp would prefer to keep thier names out of this) and did file a Barnstable County Superior Court complaint. The fact that he is connected to the Bookstore is obvious. I will be happy to show all the connections if thats what Michael wants, including the 10 page complaint. But its not necessary to go there it serves no purpose. Do we need to keep visiting this issue? Its more stories for me including public information relating to the abutting property of the Capt. Higgins. Better check with Michael first! You may be doing him a disservice.

there were no more docks allowed in Wellfleet Harbor as it was an area of critical concern by the state. Got those records also, keep going this is fun!

This is another great question! Its a double edge sword. Because the Boosktore is only permitted for 95 seats, the BOH can only force them to design a system for 95 seats. This translates to about 35 gallons per seat per day. Keep in mind they have 246 seats. So consider that! One board can only force them to design a system for the permitted 95 seats, while the other authority will not enforce, and has not enforced since 1989, the 246 seat presently there. What the hell is wrong with this picture ! Probably looking at a $200,000 dollar investment. Thats one price a town official estimated to me, I really do not know.

The gift that keeps giving! I have talked to attorneys on each issue, and was going let the people decide, but how I love a challenge ! You have to understand I do not have a agenda! But if you want facts, I happy to supply them. There is a danger in this, you may not be welcome at the Bookstore when I continue. When there is a need for a ROS, there exists a problem with the water. I do have water samples from several locations including the Bookstore, it was going to end here but maybe not now! As I said before, the oysters were great! I don't know whos grant they came from, thats another story!

Just a clarification. My writing is based on documents obtained from the Town of Wellfleet. Which include, meeting minutes, permits, filings, Failure Notices, Violation Notices, Correspondence, Court Records, State DEP records, Secretary of State Corp. Filings, interviews with Town Officials etc, etc. No rumor just facts! Try it, they area all available it just takes some effort. I do it all the time just for people like, oh well you know who you are.

Clamshelli, I appreciate your concerns and comments, but I must make the record straight. I don't even know the Parlante's. My facts are all from public records. I enjoyed a great $40+ lunch there. The fact that someone was talking openly in an area that all the customers could overhear was not spying. Yes anyone can write a blog, maybe you should consider it, base it on facts like I did. No, Michael is not the owner of record. He according to the Sec of State Records is the Treasurer of the corp. and seems to represent the Bookstore at all Public Hearings, so I don't know where your going with that. The facts are the facts, I would love to meet with the Parlantes and interview them, no flies on me! If there are they paying rent. I base my issues on facts and documents, try it! I did enjoy my oysters, all twelve of them and I never made mention of the broken shell. Arrange an interview for me I would love to talk to them. Keeping in mind there may be more to come. Nothing personal, just the facts!

Both good questions capemom. The dredging itself has nothing to do with the cave-in. The fact that the Towns attention may have been diverted from the real issue of the weakening bulkhead by the appeal filed may have drawn resources away from the problem area may be. The reasons stated were not worth mentioning, but it's all there for public inspection and I suggest interested parties go in and ask to review the file. NIMBY !

I was so hoping someday I could talk more about the 1990's ! Yes, this writer was involved with a legal battle with the former sheriff which was very well publicized. Serving at his will, I was terminated, went through a legal process, reinstated and then chose to retire. This involved many political people and entities. I think you had better check back with Mary first If you want to go here! I would love the opportunity to start a series on that caper! Unfortunately, it would bring up issues involving some people that are no longer with us.

Here it what I suggest, someone, other than me, should organize as many people as they can. The commissioners meet on Wednesdays, get a copy of the adgenda. The public comment period is always first, figure that out, and pack the office or parking lot or whatever and demand a resolution to this issue. That will get some attention, I'm just a "Blogger" and have done as much as I can, but certainly am willing to help in any way I can. I'm easy to contact!

Good Questions All!
1. A building permit was already issued and posted for demo.
2. Thier attorney was there.
3. When one of the voting members has a financial interst (famil works there) for the person that filed the complaint, it smells. Recuse thyself!
4. Yes it does!
5. Wellfleet by-laws are clear. If a vote is taken to determine continuous use and fails, there can no longer be a restaurant in that particular zone. You could partition the voters of Wellfleet to change that by-law. Lets see hearing, postings, ballot approval more hearings. What maybe 2 years!

Curious thing about voting an not recusing yourself if there is an apparent conflict.....Like being on the board, voting for water mains to extend to service you location! Oh well thats another story, and a BIG ONE!

There is a great deal of case law relating to this issue. I would suspect the Pearl people are looking into the issue. I would if I were in thier shoes.

Ok, questions at this time of night are sometime difficult to get answered. It is my understanding that monies invested in "good faith" is a business venture are lost by the investor. Unless, actions taken by a governing board,individual, or member of a board or corporation were initiated with malicious intent either filed through complaint as it relates to a legal action. There are remidies, which are much to complicated for me to explain. I am not an attorney, but there must be someone on line that can better answer this than me.

I try to stay to the facts. If you read the story, they have been reported. Obviously with all the research, quotes from individuals, records on file, complaints file in court, corporate filing records, minutes from meetings, could not be reduced to one article. Everyones comments lead me to believe this may be worthy of another article with all the facts. I have to tell you, it is time consuming, however I'm willing. Being a writer of facts there are several things that bother me regarding this situation, but here are few: An action of continuous use was filed before the September deadline! Secondly, when a person on the board has an interest (financially) in a decision, how can they vote? And a direct quote, from a board member, relating to things being overlooked if someone knows someone, is very disturbing to me and should be to all the readers and any new business owners in Wellfleet.

You are right, there is more to this story! Not wanting to create any additional hardships for anyone, I didn't want to address legal seating capacities and number of seats. That relates directly to septic issues. That would expose to big a can of worms that would only be problematic for others.

More information is developing as we blog. The artists that contributed are: John Whorf, Richard Miller, Charles Kaseleau, Charles Heinz, Julius Katzieff, Coulton Waugh, Bruce McKain, Tod Lindenmuth, Vollain B. Rann, John W. Gregory, Dorothy Lake Gregory, E.B. Warren, Donald F. Witherstine, Philip Malicoat, Bruce McKain, Ross Moffet, Ada Raynor, Edwin Dickinson, Vernon Smith. The goal of Pat VanDereck was to have at least one canvas by every competent Cape artist. Hence, we may never know exactly how many paintings were there. However, were on the right path.
