To be taken to a police station to take a chemical test, you do in fact have to be under arrest. To be asked to take a breath test into a portable breath tester you do not have to be under arrest, however, the results of, or refusal to take a portable breath test are not admissible in court, nor may the registry use that against you. Only the fixed machine at the ploice barracks counts as evidence.

Patrick, are you living in a cave somewhere? Stripe Bass has been one the most successfully rebuilt fish stocks in the country, with huge numbers, and a tightly controlled commercial fishery. AND, there are a hell of a lot more than 30 fishermen. Where in God's name did you get these facts. None of them are even close to being true, it's just more of the same old, rich sportfishermen who care less about anyone but themselves. So, GET LOST!!

John,regs are regs, this the driver may have followed all these regs and just have been stuck there with no choice. Do you recall a similar incident fairly recently when a gate closed on a car (same spot) I thought that measures had been taken after that to prevent this, that is probably where the fault lies.

Jonathan, I'm ok with the argument over the asthetics of the dismantling of the tracks, then the remaining rails being left there. I, being in favor of railroads, would also prefer they were intact. We may have different reasons for wanting them whole, but they aren't. I did a little online research about scrap prices, and guessing that one coupling weighs 10 lb, then you would need 200 of them to make $200.00, delivered to the junkyard, so I suspect that scraping isn't the reason, that would be a hell of a lot of work. Just the tools needed would be a job. Thus I suspect kids or collectors, who are collecting artifacts before they are gone, for the same reasons as you quote. Thoreau, and many more. (including me) I guess we both take the thing seriously enough..Ciao

Hi Jonathan, John, I take issue with your statement that I have no historical/emotional connection to the area. I am entirely in favor of conservation and more open space. My point is simply that taking some old pieces of metal that are trash anyway is not harming the land. If the state were concerned enough, they would take up the damn rails themselves. I would be interested to hear what you would like to eventually happen(with regards to public use)to the land. Me, if it isn't going to be railroad, they I'd prefer walking trail, not more overcrowded bike trail, but perhaps that's a done deal anyway. As for the rail bridge, who's going to maintain it? cheerrs

I have to add to this. Who says they're "stealing" anything. It's an abandoned rail bed. It's going to get torn up anyway. So Thoreau rode those rails. Yes, and?? Then I guess that means they should be kept in their current condition. Maybe it should be another national park. get over it,what you really don't like is that it is going to change from what it has been for years just like everything else on the Cape has changed. Tear up the bike path, bring back the railroad, this would be progress.

I'd rather see the railroad come back. I've always thought taking up the tracks from Hyannis to Ptown was the biggest mistake the state ever made. What a great ride it would be today, and economical also.

easier way to remove skin. just push thumb between body and fin, then lift thumb up over point and pull down, the whole skin will come off in one piece. also no need to use knife for guts. just stick thumb down in between the plastic spine and body, grip firmly and pull everything out in one pull.

A seal population this high will eventually decline naturally from a lack of food after they strip a whole area of ocean clean, and from disease. I compare them to fruit flies, they have become pests again. It was a novelty 10 years ago to watch them, now you can't get away from them.

For you older folks who have not already done so, if you have children put your house in their names NOW. It will protect your house from predators and creditors after a 5 year period. I suggest you read about the Massachsetts Estate Recovery Unit. This is who takes your house after you go into a nursing home.

Buzz is right, I am a trucker, and had made it a point to watch out for this car. I'm sorry it had the ending it did, but something about this story bothers me. 22 meds?? with no possiblity of some type of interaction? My dad had some serious problems after an open heart surgery, and after he quit taking most of his meds he was a lot better. Particularly the blood thinners.

All that said, then does it not make sense to have police doing police work and not road details if they have so much to do. Then why not have off duty firefighters do road details. Gov. Patrick is correct in allowing civvies to do flag work. The resistance is great for obvious reasons. I remember reading an article recently that one reason police morale was low was because they spent so many hours working OT on details they didn't want to really do at all.

CC Times article states he was terminated spring of '07 for unknown reason. Shouldn't have even still had the badge, and a little reprimand is order for AA for not looking at the badge a little closer. Badges are supposed to be accompanied by a valid ID.

I hope this info helps allay any fears you may have. Ducks hunters are only allowed to use steel shot while hunting. It has a very short range as compared to lead shot, which carries farther because of it's weight. Someone could literally shoot right at you with steel shot from 100 yards, and the pellets won't even reach you. Lead shot was banned many years ago because of environmental concerns. As for the poor woman in NH, high power rifles are allowed for hunting there, in Mass. only shotguns, no rifles are allowed. Happy hiking.

I had meant to say in my previous post that the required counseling program is already in place in the form of the Driver Alcohol Education Program, which is required to also discuss drug use. Teens caught with MJ could be assigned to this program easily, and upon completion have a clean slate with no record.

BUT, if Question 1 doesn't pass, you still will have an arrest record and be listed on the criminal system history. So there is a big difference. You get a sealed record that an employer wants to know what's in it. If condern about teens is that great, make it similar to alcohol, legal only over 21.

a 130,000 house (cheap by today's standards) will still have a mortgage of 1,300 a month. Plus utilities, taxes, the fair plan, etc. Most capers still can't afford that, that's why they're all gone, and not shopping at Oohlala, or a New York based clothing store.

We all now know for sure that we are getting ROBBED by cape gas stations. Statewide gas prices have been declining since July. Oil is now $90.00 per keg, gas in New Bedford last week was 3.28...C'mon oh yee politicos and DA's, They are screwing us, so it's time for us to screw them back. One factor to be considered in a shutdown of the canal plant is the enourmous cost it takes to restart a system of it's size. If it is needed for six months of the year, it needs to be left running year round, even though that can be done at a reduced power output, even minimal, but to turn off the boilers is a BIG job. Too do this every year would result in it's being closed. I don't have a + or - opinion on this, it's just a fact.

If the police are issuing tickets for noise without using a decibel meter in accordance with established legal standards, the ticket is invalid and SHOULD be dismissed. no if ands or buts

believe it or not, the best way to dispose of diesel mixed with water IS to put it overboard.(in small amounts) The wind and sun quickly evaporate the mix. It does not sink to the bottom
